Matapos makitaan ng kawalan ng sapat na ebidensya, pinalaya na mula sa pagkakakulong ang isang kasapi ng Maute clan matapos ibasura ng Department of Justice (DoJ) ang kasong rebelyon laban dito.
Pinalaya nitong Martes ng hapon si Najiya Dilangalen Karon Maute, alyas “Najiya Sultana Dilangalen Karon,” mula sa pagkakakulong makaraang maglabas ng inquest resolution ang investigating panel, na pinamumunuan ni Senior Assistant State Prosecutor Peter Ong.
Enero 23 nang inaresto si Maute sa Barangay Rosary Heights 3, Cotabato City sa bisa ng Arrest Order No. 2 na inisyu ng Department of National Defense noong Hunyo 5, 2017 na may kaugnayan sa Marawi siege.
Gayunman, sinabi ng DOJ na ang reklamo na inihain ng Philippine National Police-Criminal Investigation and Detection Group (PNP-CIDG) ay hindi na naaayon, dahil ang insidente ay nangyari noong Mayo 2017, at dapat na ang kaso ay isailalim sa regular preliminary investigation.
Sa Pebrero 14 itinakda ng DoJ ang unang preliminary investigation hearing.
“Complainant PNP-CIDG claims that on the basis of the statement of Martino Elyana, respondent Najiya Maute should be indicted for rebellion for aiding the Maute-ISIS group who participated in the public uprising and took arms against the government by forcibly taking over Marawi City. On two separate occasions, respondent Najiya Maute’s aid to the armed group was in the form of giving them food. However, aside from the statement of Martino Elyan, complainants did not present any other evidence against respondent,” saad sa resolusyon nitong Enero 29.
“Besides, at the time respondent was arrested on January 23, 2018, there is no evidence or even allegation that she was committing, about to commit, or has just committed, an offense,” dagdag pa.
