Naghain ang mga abogadong sina Atty. Manuelito Luna, Atty. Ferdinand Topacio, at Atty. Harold Respicio ng petition for indirect contempt sa Supreme Court laban kay Senate President Vicente “Tito” Sotto III dahil lumalampas na umano ito sa “legitimate commentary.”
Ayon sa naging paliwanag ni Topacio nitong Biyernes, Pebrero 13, 2026, sinabi niyang lumalabag na raw sa “territory of statement” ang mga sinasabi ni Sotto na naglalayon umanong sirain ang kredibilidad ng Korte Suprema sa taumbayan.
“Para po sa amin ay ‘yun pong mga public statement ni Senate President Tito Sotto III, with all due respect to him, ay lumalampas na po sa legitimate commentary at ito po ay nagta-transgress na into the territory of statement that tend to demean and destroy the credibility undermine the faith of the people in the Supreme Court,” pagsisimula niya.
Dagdag pa niya, “Lalong lalo na po ‘yong mga statement niya, for example sasabihin niya, mas magaling pa ang first year law students kaysa sa mga mahistrado ng Korte Suprema.”

Ani Topacio, para raw sinabi ni Sotto na hindi raw umano naiintindihan ni SC Senior Associate Justice Marvic Leonen ang Konstitusyon o walang alam sa rules.
“Parang in-amend na ang Konstitusyon, hindi naintindihan ng ponente na si Senior Associate Justice Leonen—walang alam sa rules,” aniya.
Giit niya, “Para sa amin po, hindi na po ito tama lalong lalo na sa isang tao na siya po ang pinuno ng upper chamber ng ating Kongreso.”
Paglilinaw naman ni Topacio, hindi raw nilalayon ng paghahain sa Korte Suprema na patahimikin si Sotto.
“Hindi po ito para patahimikin si Senate President Sotto, katulad ng sinasabi ng iba. He’s free to say what he want basta ito po ay hindi bumabalangkas sa rules on contempt and what is permissible na sabihin [niya],” saad niya.
Diin pa niya, “Sapagka’t the Supreme Court, being one of the three great departments of government, is entitled from the other two departments.”
Ayon pa kay Topacio, hindi lang daw puwede na bastusin na lang ang Korte Suprema dahil hindi naman daw nito binabastos ang Kamara at Senado.
“Hindi puwedeng bastusin na lang. Hindi naman po binabastos ng Supreme Court ang Senado o mababang kapulungan…” pagtatapos niya.
Samantala, habang sinusulat ito, wala pa namang inilalabas na tugon, reaksyon, o pahayag si Sotto kaugnay rito.
