Ibinasura ng Commission on Elections (Comelec) First Division ang isinampang disqualification case laban sa limang miyembro ng Tulfo clan, kabilang na sina senatorial candidates ACT-CIS Rep. Erwin Tulfo at broadcaster Ben Tulfo.
Base sa desisyon ng Comelec na inilabas ng NewsWatch Plus nitong Martes, Marso 4, hindi umano nakapagbigay ang naghain ng petisyon ng mga kopya ng certificate of candidacy (COC) ng limang Tulfo na mahalaga raw para maberipika ang mga impormasyon kaugnay ng reklamo.
“Upon scrutiny of the submitted Petition and its attachments, it appears that the Petitioner failed to provide the copies of Respondents' COCs, which would have been vital in order to properly verify the necessary information alleged in the Petition. Consequently, it cannot also be verified whether the Petition was properly served to the Respondents,” anang Comelec.
“Settled is the rule that failure to comply with a mandatory requirement warrants the dismissal of the Petition,” dagdag pa.
Sinabi naman ni Comelec Chairman George Garcia na maaari pa ring maghain ang petitioner ng motion for reconsideration.
Matatandaang noong Pebrero 18 nang sampahan ng disqualification case ang magkapatid na Tulfo, kasama ang kamag-anak nilang sina ACT-CIS Rep. Jocelyn Pua-Tulfo (asawa ni Sen. Raffy Tulfo), Quezon City 2nd District Rep. Ralph Wendel Tulfo (anak nina Sen. Raffy at Rep. Jocelyn), at Turismo party-list nominee Wanda Tulfo-Teo (kapatid ng Tulfo Brothers).
Inihain ang disqualification case ng abogadong si Virgilio Garcia, kung saan iginiit nito sa petisyon ang usapin ng “political dynasty.”
