Kakasuhan si dating Philippine Health Insurance Corporation (PhilHealth) president Ricardo Morales at ilan pang matataas na opisyal ay kaugnay sa sinasabing mga anomalya sa korporasyon mg estado.

Inaprubahan ni Pangulong Duterte ang mga rekomendasyon ng panel na pinamunuan ng Department of Justice, kasama ang pagsasampa ng mga reklamong administratibo at kriminal laban sa mga opisyal ng PhilHealth kaugnay sa irregular na pagbili ng mga information technology equipment, Interim Reimbursement Mechanism (IRM), at iba pa.

Sa kabilang banda, si Health Secretary Francisco Duque III, na nagsilbi bilang PhilHealth chairman,!ay hindi kasama sa listahan ng mga opisyal na sasampahan ng kaso sa umano’y graft, malversation of public fund, dishonesty, grave misconduct, at iba pa. Inirekomenda lamang ng task force ang adminition ng chairman ng PhilHealth kaugnay sa mga anomalya sa tagaseguro sa kalusugan ng estado.

Binasa ng Pangulo ang mga bahagi ng ulat na isinumite ng task force tungkol sa imbestigasyon sa katiwalian sa PhilHealth sa kanyang televised press briefing nitong Lunes ng gabi.

Lalaking ipinagpalit daw sa pangit, nanaksak ng hindi kilala!

“The issue of PhilHealth corruption was really an important issue to the Filipinos and to everybody. And everybody again is also placed in jeopardy by the actions of the officials,” sinabi ni Détente.

“I’m sorry for them but you have to undergo trial. Although they can always prove their guilt beyond reasonable doubt. The presumption of innocence still attaches but the report of another agency says otherwise. So ganun ang nangyari sa PhilHealth. Halos lahat sa board,” aniya.

Sa kalaunan ay inihayag ni Presidential Spokesman Harry Roque na pumayag ang Pangulo sa mga rekomendasyon ng task force. “Among those who will be charged criminally and administratively are: ex-president Morales, SVP (Jovita) Aragona, OIC (Calixto) Gabuya (Jr.), SVP (Renato) Limsiaco (Jr.), SVP (Israel Francis) Pargas, COO (Arnel) De Jesus, (Division chief Bobby) Crisostomo, etc,” sinabi ni Roque.

Sa pagbabasa ng ulat, sinabi ng Pangulo na ang Pangulo na ang task force ay nakatipon ng ebidensiya na nagpapakita ng “wrongful acts or omissions of certain key corporate officers of PhilHealth have committed.”

“The negligence exhibited by certain officers of the PhilHealth executive committee gives rise to both administrative and criminal liability and the following laws are Republic Act No. 3019, it’s the Anti-Graft and Corrupt Practices law, the Penal Code --sa Revised Penal Code, the malversation of public funds or property and the illegal use of public funds and property, gross misconduct, gross neglect of duty under Civil Service rules,” sinabi ni Duterte, na nakasaad sa ulat.

Inirerekomenda ng task force recommended na “the President strongly admonish and remind the chairman and members of the board of grave consequence of their action or inaction to PhilHealth fund to the government and its coffers and to the interest of the ordinary people who rely on PhilHealth assistance.”

Inirekomenda din nito ang pagtuloy sa criminal liability ng mga opisyal ng PhilHealth para sa sinasabing graft at malversation ng mga pampublikong pondo. Ang mga opisyal ay maaari ding managot sa paglabag sa national internal revenue code kaugnay sa kanilang diumano’y kabiguan na i-withhold ang mga buwis sa IRM releases.

Preliminary investigation

Samantala, nilinaw ng DOJ na isasailalim pa sa preliminary investigation ang mga opisyal ng PhilHealth na inirekomendang kasuhan.

Ayon kay DOJ Usecretary Markk Perete, ang rekomendasyon ng task force ay sampahan ng reklamo ang mga opisyal ng PhilHealth na ang ibig sabihin ay sasailalim pa sa preliminary investigation ang mga opisyal bago matukoy kung isasampa sa korte ang mga kaso.

Kaya naman, paliwanag ni Perete, sa proseso ng preliminary investigation ay mabibigyan ng pagkakataon ang PhilHealth officials na ipagtanggol ang kanilang sarili.

“Maaaring isampa ang reklamo sa Office of the Ombudsman o kaya naman ay sa piskalya,” ani Perete.
