Ipinag-utos na ng Court of Appeals (CA) ang pamamahagi sa P3.9-bilyon pension differential para sa mga retiradong opisyal at tauhan ng binuwag na Integrated National Police (INP) mula 1991 hanggang 2006.

“The INP Retirees have been deprived of their pension differentials for a considerable length of time,” nakasaad sa desisyon ng CA 11th Division na isinulat ni Associate Justice Pedro Corales at kinatigan nina Associate Justices Sesinandon Villon at Rodil Zalameda.

“After complying with all the requirements for execution of their monetary claims, i.e., filling a case before the COA (Commission on Audit) and securing from the PNP (Philippine National Police) a duly authenticated list of INP Retirees with the corresponding computation of their respective pensions, it would be highly unjust and inequitable for DBM (Department of Budget and Management) to withhold from them the amount duly appropriated by Congress for satisfaction of the final and executory judgment in their favor,” iginiit ng appellate court.

Dahil dito, ibinasura ng CA ang petition for certiorari na inihain ng DBM na humihiling ng temporary restraining order o writ of preliminary injunction (WPI) laban sa kautusan ng Manila Regional Trial Court (RTC) Branch 32 na inilabas noong Pebrero 20, 2014 na nag-aatas sa kagawaran na ipatupad ang kautusan ng Supreme Court noong Mayo 9, 2007 base sa pagpapatupad ng General Appropriations Act of 2014.

Pinigilan ng CA ruling ang paglalabas ng TRO at WPI laban sa notice of garnishment ng Manila RTC sa Land Bank of the Philippines (LBP), na inatasang mangalaga sa pension fund ng mga retiradong tauhan at opisyal ng INP.

“Accordingly, concerns about the insufficiency or soundness of a statutory appropriation must be properly addressed to Congress, not the judiciary,” giit ng CA. (Jeffrey G. Damicog)
