Kampo ni FPRRD, umapela sa ICC ng kaniyang immediate, unconditional release!

Naglahad ng bagong argumento ang defense team ni dating Pangulong Rodrigo Duterte sa International Criminal Court (ICC) at pormal na umapela sa kaniyang “immediate” at “unconditionally release.” 

Ayon ito sa ipinasang dokumento ng kampo ni FPRRD na naglalaman ng 21 mga pahina noong Nobyembre 14, 2025 sa Pre-Trial Chamber I ng ICC.

Isa sa mga pangunahing idiniin nila ay ang mga “error” ng ICC sa “jurisdiction” nito sa bansa at pagtutuloy ng kaso ng dating Pangulo kahit tumiwalag na raw ang Pilipinas sa kanila noon. 

“The Pre-Trial Chamber further ruled that, for the purposes of articles 12(2) and 13(c) of the Statute, the Court may not exercise its jurisdiction if, at the time that the Prosecutor has initiated an investigation, the State concerned is no longer a Party to the Statute[...]” mababasa sa nasabing dokumento.

“According to the Pre-Trial Chamber, "article 127 [...] was specifically enacted as lex specialis to set out the regime that would apply to the exceptional circumstance of a State that withdraws from the Statute[...],” anila. 

Dagdag pa nila, hindi rin daw nila nakita sa mahigit 10,500 mga pahina sa documented preparatory negotiation sa Rome Statue ang sinabi nilang “lex specialis.” 

“The Impugned Decision does not cite a single authoritative source in support of its contention that Article 127(2) was "specifically enacted as lex specialis" in relation to Article 12. Indeed, the words "lex specialis' appear nowhere in any of the 10,531 pages of documented preparatory negotiations to the Rome Statute,” giit pa nila. 

Dahil umano rito, “the Defence submits that the Prosecution, out of intellectual consistency, cannot now argue in favour of the Impugned Decision in the present appellate proceedings. To do so would be to contradict its own position throughout the process.”

Pagpapatuloy pa nila, nagkamali raw ang Pre-Trial Chamber sa paggigiit na ang isang preliminary examination ay statutory process umano sa ilalim ng Article 15 ng Statute at Rules 46 hanggang 50 ng Rules of Procedure and Evidence.

“The Pre-Trial Chamber is mistaken in asserting that a preliminary examination is a statutory process regulated by Article 15 of the Statute and Rules 46 through 50 of the Rules of Procedure and Evidence,” depensa nila. 

“No statutory provisions govern the nature and conduct of a preliminary examination, and there exist no legal or jurisdictional limitations on the Prosecutor's ability to open a preliminary examination into any situation as he or she sees fit, even concerning matters impacting the interests of a Non-State Party,” paliwanag pa nila. 

Sa huli, pormal na umapela sa Pre-Trial Chamber I ang kampo ni FPRRD na "i-reverse" ang mga desisyon nito, tingnan na wala raw umanong legal na basehan para ituloy pa ang pagdinig ng ICC, at ipag-utos ang mabilis at “unconditional release” ng dating Pangulo.
