Kinontra ni Senate Minority Leader Vicente “Tito” Sotto III ang mosyon ni Sen. Rodante Marcoleta na tuluyan nang i-dismiss ang impeachment ni Vice President Sara Duterte alinsunod sa naunang desisyon ng Korte Suprema.

Sa pagtalakay ng Senado sa nasabing desisyon ng Supreme Court (SC) nitong Miyerkules, Agosto 6, 2025, tinapatan ni Sotto ng motion to table ang mosyon ni Marcoleta.

“I move to table the motion to dismiss. A motion to table is a higher precedence than motion to dismiss,” ani Sotto. 

Saad pa ni Sotto, “Let us not dismiss forthwith.”

Sa ilalim ng motion to table, pansamantalang isinasantabi ng Senado ang isang mosyon hanggang sa muli na ulit itong buksan upang mapagdebatihan at mapag-usapan. Sa pag-iisantabi, hindi ito nangangahulugang ibinabasura na ang naturang mosyon.

Matatandaang mariing ibinala ni Marcoleta na ang desisyon umano ng Supreme Court ang sapat ng basehan upang ibasura na ng Senado ang impeachment ni VP Sara.

“Mr. President, when the Supreme Court (SC) negates the actions of a co-equal branch of government, it does not assert its superiority. Instead, it upholds the supremacy and the dominance of the fundamental law of the land—-the Constitution,” ani Marcoleta.

Dagdag pa niya, “It says the complaint is unconstitutional, is void ab initio, is violative of due process. The Senate never acquired jurisdiction over this. It is immediately executory. And on that note, Mr. President, I respectfully move that the impeachment complaint be dismissed.”

Ayon sa nasabing desisyon ng SC,”The SC has ruled that the House impeachment complaint versus VP Sara Duterte is barred by the one-year rule and that due process or fairness applies in all stages of the impeachment process.”
