Kinasuhan ng cyber libel ang aktres na si Lindsay Custodio ng kaniyang mister na si Frederick Cale kaugnay ng panayam sa kaniya ng isang media company na nailathala sa dalawang online websites nito.

Sa "Fast Talk with Boy Abunda," ibinalita ni Boy na sinampahan ng kaso si Lindsay sa Prosecutor's Office sa Mandaue City, Cebu.

Kaugnay ito sa dalawang artikulong lumabas noong 2024 na may kinalaman umano sa pagka-trauma ni Lindsay sa mismong wedding day nila ng mister noong 2022.

“Sa nasabing article, Lindsay alleged na bago sila pumunta sa wedding reception ay pinilit umano ng kaniyang asawa na dumaan sila sa bangko para i-withdraw ang kanilang mga regalong tseke pati na ang pera mula sa kaniyang personal account at sa kanilang joint account para ipambayad sa kanilang wedding expenses," saad ni Boy sa kaniyang programa, Miyerkules, Marso 5.

Dagdag pa, nasa Cebu na raw si Lindsay para asikasuhin ang preliminary investigation dahil doon nga nag-file ang kaniyang asawa.

Samantala, damay rin umano sa reklamo ang Philippine Entertainment Portal o PEP gayundin ang Smart Parenting dahil daw sa paglalathala ng panayam kay Lindsay.

Naglabas na rin ng paglilinaw tungkol dito ang PEP nitong Miyerkules, sa pamamagitan ng isang artikulo. Batay raw sa affidavit na isinumite ng mister ni Lindsay, ang mga pahayag ng misis sa nailathalang artikulo noong 2024 ay nakasira sa kaniyang pagkatao at reputasyon.

“Both posts and publication on-line were published by PEP.ph and smartparenting.ph, both under the Summit Media, through the highly fabricated and false stories of the Respondent Custodio-Cale containing malicious imputations with bad intentions and unjustifiable motives, purposely to malign, dishonor, discredit, insult, and assassinate my character and good reputation to the public,” mababasa sa affidavit ng kampo ni Cale, na nasa write-up article naman ng PEP.

Sa nabanggit na artikulo ay mababasa naman ang opisyal na pahayag ng PEP at Smart Parenting sa pamamagitan ni Atty. Alex Castro ng Azcuna Yorac Sarmiento Arroyo Chua Coronel & Reyes Law Firm.

 "In their Counter-Affidavit filed on 5 March 2025, the PEP and Smart Parenting editors argued that the complaint should be dismissed because two essential elements of the crime of cyberlibel are lacking," mababasa. 

Sa pagpapatuloy, "First, the element of allegation by the respondents of a discreditable act or condition concerning the complainant is not present, as PEP and Smart Parenting merely reported on the information provided by Ms. Lindsay Custodio, sans any personal comments or opinions.

"Second, the element of the existence of malice on the part of the respondents is also lacking as the subject articles are fair and true reports, made in good faith, on the information provided by Ms. Custodio, as confirmed by relevant documents."

"In light of the foregoing, it is the position of PEP and Smart Parenting that the subject complaint filed against them for cyberlibel should be dismissed," dagdag pa nila.
