"PNP Chief Marbil, pls we need confirmation if this is what you ordered to be done in the basement of our beloved Jose Maria College. What we can hear is only the sound of the drilling equipments, we need confirmation if this is true, please allow us access to go into the JMC Basement," bahagi ng post ni Atty. Torreon noong Setyembre 1.

"We are once again demanding to PNP Chief Marbil access to the JMC Basement because this picture shows a real and serious attempt to establish a tunnel therein. We need to confirm the authenticity of this picture sent to me in confidence because after ten (10) days of non-stop and continuous search by 3000 policemen, the police have not found Pastor ACQ..." bahagi ng kaniyang post.

Dagdag pa, “In a search incidental to a lawful arrest, the law requires that there must first be a lawful arrest before a search can be made; THE PROCESS CANNOT BE REVERSED."

"So it is clear that all the Police Officers who participated in these illegal acts can really be made criminally, civilly and administratively liable. Knowing that the value of the properties near the airport is now P100,000 per square meter, then brace yourselves gentlemen, this will haunt you!

Torreon.

Mababasa sa buong FB post ng legal counsel, "I thought the police was so sure of the location of Pastor ACQ that they even dug a tunnel in the JMC Basement. The PNP Spokesman even used Rule 113 Section 11 as justification for their continued stay even if 11 days have already elapsed since they began their illegal search in the KOJC Compound."

"But what baffles me is that after 11 days, still no result? The hole in the JMC Basement has become dangerously big threatening the stability of the buildings yet they have not seen any tunnel yet? Which brings me to the legal question as to whether the 'reasonable belief” of the presence of Pastor ACQ justify the tunneling and thereby the possible destruction of the JMC Building?"

"I thought reasonable belief meant that they have A-1 knowledge that Pastor is present there and there is no need of an intrusive search. But the fact that they have to dig a big tunnel without even finding an existing tunnel after eleven days simply means that their belief therefore of pastor’s presence therein is unreasonable, if not, downright speculative. Then if that is the case If they were too sure of the tunnel, why can’t they locate its entrance?"

"All law students know that any search that is conducted in a person’s property is only possible if the court issued a valid search warrant. The only incident that allows a warrantless search during an arrest is when it constitutes a search incidental to a lawful arrest. But in this case, after 11 days, there is no arrest yet the police has conducted, and is continually conducting, a very intrusive search of properties not even registered in the name of the Accused."

"In People versus Nuevas, the Supreme Court declared : 'in a search incidental to a lawful arrest, the law requires that there must be a lawful arrest before a search can be made; the PROCESS CANNOT BE REVERSED!'"

"General Marbil, please grant us access to the JMC Basement so that we can confirm this, 8 meters na daw kalalim at wala pa rin ang bunker mo. Please stop this madness!" aniya pa.
