Nilagdaan ni Pangulong Benigno Aquino III ang Republic Act (RA) No. 10757 na nagbababa sa retirement age ng surface mine workers mula sa 60 ay naging 50 anyos na.

Inaamyendahan ng batas ang Article 302 ng Presidential Decree No. 442, o mas kilala bilang Labor Code of the Philippines. Nilagdaan ito ng Pangulo noong Abril 8, 2016.

“The State recognizes the vulnerability of miners due to the presence of innumerable harmful elements in their profession leading to more serious health problems, especially as these individuals age, and how the circumstances are more dangerous compared to the ordinary worker far away from mines,” nakasaad sa bagong batas.

“An underground or a surface mining employee, upon reaching the age of 50 years or more, but not beyond 60 years which is hereby declared the compulsory retirement age for both underground and surface mine workers, who has served at least five years as underground or surface mine worker may retire and shall be entitled to all the retirement benefits provided for in this Article,” dagdag dito.

Kabilang sa surface mine workers ang mill plant workers, electrical, mechanical, at tailings pond personnel.

Hindi sakop ng probisyong ito ang retail service at agricultural establishments o mga operasyon na may mas mababa sa 10 empleyado o manggagawa.

Ang anumang paglabag sa probisyon ay may katumbas na parusa sa ilalim ng Labor Code.

Magkakabisa ang bagong batas 15 araw matapos itong mailathala sa Official Gazette o sa alinmang pahayagan na mayroong general circulation. (MADEL SABATER - NAMIT)
