Nilinaw ng Malacañang na may tungkulin ang Office of the Ombudsman na imbestigahan si Senator Richard “Dick” Gordon sa paniwalang nagbulsa umano ang senador ng ₱86 milyon nang patakbuhin nito ang Subic Bay Metropolitan Authority (SBMA) mula 1992 hanggang 1998.
Ito ay nang magbanta muli si Pangulong Rodrigo Duterte na hihilingin nito sa nasabing anti-graft agency na silipin ang usapin sa hindi umano pagsasauli ni Gordon ng₱86 milyon sa pondo ng bay
Sa isang Kapihan sa Manila Bay forum nitong Martes, ipinaliwanag niPresidential Spokesperson Harry Roque na nais ng Pangulo na ipatupad ng Ombudsman ang mandato nito alinsunod sa Konstitusyon laban sa senador.
“It is the Ombudsman’s mandate under the Constitution to initiate investigations and to file information before the Sandiganbayan against the highest officials of the land,” ayon kay Roque.

Nilinaw din ni Roque na hindi pangingialamsa trabaho ng Ombudsman ang pahayag ng Pangulo. Hindi aniyuainuutusan ni Duterte ang Ombudsman at nais lamang umano ng Pangulo kung may kriminal na pananagutan si Gordon.
“He (Duterte) is not ordering. He’s asking the Ombudsman to in fact perform its constitutional duty to implement and ensure compliance with our anti-graft laws,. When there is a disallowed [fund], that means therewas misappropriationfund which constitutes a separate criminal offense other than the obligation to make reparation, return the money that should have been spent in the first place,” ikinatwiran pa ni Roque.
