Nagsampa ang National Bureau of Investigation ng reklamo sa Department of Justice laban kay dating Customs Commissioner Isidro Lapeña at sa iba pang mga sangkot sa pagkakapuslit sa Bureau of Customs ng P11-bilyon halaga ng shabu na isinilid sa mga magnetic lifters.
Kabilang din si dating BoC intelligence officer Jimmy Guban sa mga sinampahan ng dereliction of duty, grave misconduct, at paglabag sa Anti-Graft and Corrupt Practices Act.
Bukod kina Lapeña at Guban, kinasuhan din kahapon ng NBI ng importation of illegal drugs, graft at grave misconduct sina dating Philippine Drug Enforcement Agency (PDEA) Deputy Director General Ismael Fajardo, Jr., dating Philippine National Police-Anti-Illegal Drugs Group (PNP-AIDG) OIC Senior Supt. Eduardo Acierto, Insp. Lito Pirote, Joseph Dimayuga, at iba pa.
Ang kaso ay nag-ugat sa pagkakadiskubre ng shabu sa dalawang magnetic lifters sa Manila International Container Port (MICP) at apat na magnetic lifters sa isang bodega sa Cavite.
“The BoC was headed by Commissioner Lapeña during the issue in the magnetic lifters arise. Accordingly, Commissioner Lapeña has the duty to exercise any customs power and functions in accordance with Section 20, in relation to Section 202 of the Customs and Tariff Act (CMTA) or RA 10863,” saad sa reklamo ng NBI.
