May sapat na kapangyarihan si Senator Leila de Lima sa protective custody ng kanyang testigo at bilang chairperson ng isang komite, at hindi din ito pwedeng tutulan ni Senate President Aquilino Pimentel III.

Ayon kay Senate President Pro Tempore Franklin Drilon, ang Senate Committee on Justice and Human Rights na pinamumunuan ni De Lima ay may sapat na kapangyarihan para ikustodiya si Edgar Matobato, ang self-confessed member ng Davao Death Squad (DSS).

“It is an inherent power of every Senate committee to provide protective custody to any of its witnesses or resource persons, whose testimonies are crucial in the exercise of their functions. Such power cannot be vetoed by the Senate President,” ani Drilon.

Aniya, ang paggamit ng Senado bilang proteksyon sa testigo ay diskresyon na ni Pimentel, pero hindi naman pwdeng pakialaman pa ni Pimentel kung ano ang balak ng komite.

Sinabi pa ni Drilon na pwedeng gamitin ni De Lima ang budget ng kanyang komite para tiyakin ang kaligtasan ng testigo.

Magugunita na ininguso ni Matobato si Pangulong Rodrigo Duterte at anak nitong si Paolo sa ilang insidente ng pagpaslang na isinagawa ng DDS sa Davao City. (Leonel M. Abasola)
