Nagbabala ang Integrated Bar of the Philippines (IBP) na delikadong amyendahan ang 1987 Constitution upang bawasan ang kapangyarihan ng Korte Suprema at tiyakin na walang pag-abuso sa Ehekutibo at Lehislatura.

Sinabi ni IBP President Vicente Joyas na ang pagbabago ng isip ni Pangulong Benigno S. Aquino III sa isyu ng pag-amyenda sa Konstitusyon ay patunay na kakaunti ang respeto nito sa batas.

“This (amending the Constitution) is really dangerous especially if its main purpose is to curtail the judiciary, especially the Supreme Court. It seems that they want a government that is similar during the martial law years,” pahayag ni Joyas.

Ipinaliwanag ni Joyas na ang kapangyarihan ng judicial review ay upang maiwasan ang pag-abuso sa dalawang sangay ng gobyerno at ito ay nakasaad sa Konstitusyon.

“The provision in our Constitution regarding the power of judicial review is to prevent abuses and this was approved during the presidency of President Aquino’s mother and it was approved by his ‘bosses,” giit ni Joyas.

Biglang nagbago ang hihip ng hangin para kay PNoy nang ihayag niya kamakalawa na bukas siya sa panukalang baguhin ang Konstitusyon, hindi lamang upang mapalawig ang kanyang termino subalit upang mabawasan ang kapangyarihan ng Korte Suprema.

“When I took this office, I recall it was only for one term of six years. Now, after having said that, of course, I have to listen to my bosses,” inihayag ng Pangulo sa isang panayam sa telebisyon.

“Before all of these happened, I admit I had a closed mind. But now I realized that there is judicial reach. Congress and the Executive may act but they can be punished anytime,” dagdag ng Pangulo.

Tinukoy ng Punong Ehekutibo ang dalawang desisyon ng Korte Suprema na nagdedeklara sa Priority Development Assistance Fund (PDAF) at Disbursement Acceleration Program (DAP) bilang unconstitutional.

Dahil dito, ilang beses binatikos ni Aquino sa publiko ang Korte Suprema.
