Kumbinsido ang isang poll official na dapat na hindi na umeksena ang Commission on Elections (Comelec) sa paghahain ng komento at makibahagi sa oral argument sa mga kaso ng diskuwalipikasyon laban kay Sen. Grace Poe.
Naniniwala si Comelec Commissioner Christian Robert Lim na ang Comelec ay isang “nominal party” lamang sa mga kasong inihain laban kay Poe dahil ito ang magdedesisyon sa isyu.
“It is believed that the Commission would maintain its independence and impartiality, and would actually appear to be independent and impartial if it did not actively participate in the proceedings,” inihayag ni Lim sa kanyang hiwalay na opinyon na nakasaad din sa Comelec Resolution No. 10039 na inilabas noong Biyernes.
“It is the position of the undersigned that the Commission en banc must leave to the respective parties the obligation to defend their individual positions,” dagdag ni Lim.

Tinukoy ni Lim ang mga respondent na sina Estrella Elamparo, dating University of the East Law Dean Amado Valdez, dating Sen. Francisco “Kit” Tatad, at De La Salle University Professor Antonio Contreras, upang idepensa ang kasong kanilang inihain.
Samantala, sinabi ni Comelec Chairman Andres Bautisa na ipagpapatuloy ng en banc ang talakayan nito sa panukalang pagtatatag ng Comelec Ethics Committee.
“Subject to continuing discussions regarding the procedure in the filing of pleadings in the SC and the creation of an ethics committee,” inihayag ni Bautista sa resolusyon. (LESLIE ANN AQUINO)
