Hiniling ng mga huwes ng Manila Regional Trial Court (RTC) sa Korte Suprema na pigilan ang Bureau of Internal Revenue (BIR) sa pagpapatupad ng 32 porsiyentong buwis sa allowance, bonus, compensasyon sa serbisyo at iba pang benepisyo ng mga kawani ng gobyerno, kabilang ang mga nasa hudikatura.

Sinabi ng mga huwes sa Korte Suprema na nilabag ng Revenue Memorandum Circular No. 23-2014 ang fiscal autonomy ng hudikatura sa ilalim ng Section 3 at 10 ng Artilce VIII ng Konstitusyon.

“The independence of the judiciary enshrined in the Constitution demands that said Memorandum should not apply to members of the judiciary,” paliwanag ng mga miyembro ng Regional Trial Court Judges Association of Manila (RTCJA-Manila).

Hiniling ng mga huwes sa SC na magpalabas ng isang temporary restraining order laban sa kontrobersiyal na memorandum circular.

Una nang inatasan ng Korte Suprema si Finance Secretary Cesar Purisima at BIR Commissioner Kim Jacinto Henares na magbigay ng komento sa petisyong inihain ng Confederation of Unity, Recognition and Advancement of Government Employees (Courage) na bumabatikos sa RMC 2301014.

Sa petisyon na inihain ni RTCJA President Judge Armando Yanga, sinabi ng grupo: “The assailed RMC significantly increased the burden of the officials and employees of the judiciary without due observance of the requirements of notice and hearing for the benefit of those affected thereby, and without being duly published in accordance with the prescribed legal formalities.” - Rey G.
