Umaalma at nababahala na rin ang Commission on Human Rights (CHR) sa 'no vax, no ride' policy ng Department of Transportation (DOTr) dahil paglabag umano ito sa pangunahing mga karapatan ng mamamayan.
Inihayag ni CHR Spokesperson Jacqueline Ann de Guia nitong Miyerkules, Enero 12, mayroon nang ipinatutupad na “no vaccine, no labas” policy ang gobyerno at iginagalang nila ito dahil hindi naman umano ito magreresulta sa pagkakait ng paggamit ng pampublikong transportasyon .
“CHR fears that, while there is no direct prohibition on the right to travel with the ‘no vaccine, no ride’ policy in public transport for the unvaccinated, this policy effectively restricts the exercise and enjoyment of fundamental rights,” sabi ni De Guia.
Pagbibigay-diin nito, pawang karaniwang mamamayan ang tatamaan ng patakaran ng DOTr dahil gumagamit ang mga ito ng pampublikong transportasyon upang maabot ang mga pangunahing pangangailangan katulad ng pagkain, trabaho at serbisyo sa mga ospital.

“With the DOTr‘s ‘no vaccine, no ride’ policy, even those exempted under this policy may be restricted in accessing essential goods and services for having no or limited access to private vehicles,” aniya.
Inihalimbawanito angHuman Rights Committee-General Comment No. 27 kaugnay ng kalayaan sa kanilang galaw:“It is not sufficient that the restrictions serve the permissible purposes; they must also be necessary to protect them. Restrictive measures must conform to the principle of proportionality; they must be appropriate to achieve their protective function; they must be the least intrusive instrument amongst those which might achieve the desired result; and they must be proportionate to the interest to be protected."
Kaugnay nito, iminungkahi niya sa pamahalaan na pag-aralan muli ang ipinatutupad na paghihigpit laban sa mga hindi pa bakunado upang matiyak na hindi ito lalabag sa batas.
