Pinagtibay kahapon ng Supreme Court (SC) ang deklarasyon ng batas militar sa Mindanao.
Sa botong 11-3-1, kinatigan ng mga mahistrado ng Korte Suprema ang Proclamation No. 216 ni Pangulong Rodrigo Duterte na nagdedeklara ng martial law at sumususpinde sa prebilehiyo ng writ of habeas corpus sa Mindanao sa loob ng 60 araw.
Bukod-tanging si Associate Justice Marvic Leonen ang bumoto laban sa proklamasyon ng batas militar sa Mindanao.

Labing-isa sa mga mahistrado ang pumabor sa deklarasyon ng martial law: sina Associate Justices Mariano Del Castillo, Presbitero Velasco, Teresita de Castro, Diosdado Peralta, Lucas Bersamin, Jose Mendoza, Estela Perlas-Bernabe, Francis Jardeleza, Bienvenido Reyes, Samuel Martires, at Noel Tijam.
Tatlo naman sa mga mahistrado ang nagsabing dapat limitahan ang saklaw ng batas militar at hindi tamang ipairal sa buong rehiyon. Sila ay sina Chief Justice Maria Lourdes Sereno, Senior Associate Justice Antonio Carpio, at Associate Justice Alfredo Benjamin Caguioa.
Nangangahulugan ito na kumbinsido ang SC na mayroong sufficient factual basis sa pagdedeklara ng martial law.
Ibig ding sabihin, ibinabasura ng Korte Suprema ang consolidated petitions na inihain ng grupo ng mga mambabatas mula sa oposisyon, sa pangunguna ni Albay Rep. Edcel Lagman, ng mga militanteng grupo ng Bayan, Gabriela, ACT Party-list at Kabataan Party-list; at apat na residente ng Marawi City, Lanao del Sur.

Kaugnay nito, sinabi ni Atty. Cristina Yambot, abogado ng grupong Bayan, na plano nilang maghain ng motion for reconsideration sa loob ng 15 araw.
Sa isang pahayag, kinondena rin ni Bayan Secretary General Renato Reyes ang nabanggit na desisyon ng SC, sinabing binigyan nito ng legal na batayan ang pagpapalawig sa martial law.
Samantala, nagpahayag naman ang pamunuan ng pulisya at militar ng posibilidad na irekomenda nila sa Pangulo ang pagpapalawig sa batas militar sa Mindanao.
Ayon kay Philippine National Police (PNP) chief Director General Ronald dela Rosa, nag-usap na sila ni Armed Forces of the Philippines (AFP) chief of staff General Eduardo Año nitong Lunes at kapwa sila bukas sa pagpapalawig sa martial law kung mananatili ang krisis sa Marawi.
EXTENSION IREREKOMENDA
“We are inclined to recommend to the President that if possible, since the situation has not yet stabilized, it would be better that it would be extended for the rehabilitation of Marawi City,” sabi ni dela Rosa. “It would be difficult to go on with the rehabilitation with the firefight still on-going. To make sure that it is safe to conduct rehabilitation, Martial Law should be extended to ensure the positive outcome of the reconstruction, rehabilitation of Marawi.”
Matatandaang idineklara ng Pangulo ang batas militar sa buong Mindanao ilang oras makaraang salakayin ng Maute Group ang Marawi nitong Mayo 23.
“So if we would be asked by the President, General Año told me that we might as well recommend the extension even for a few days,” sabi ni dela Rosa.
“But it (discussion with Año) was yesterday (Monday), things may vary as days go by,” mabilis na dagdag niya. “If the situation changes there, our recommendation may also change, depending on the situation in Marawi City.”
Una nang sinabi ng Pangulo na tanging ang pamunuan ng militar at pulisya ang pakikinggan niya sa pagdedesisyon kung palalawigin pa ang batas militar sa Mindanao.
