Binanatan ng defense lead counsel na si Atty. Sheila Sison ang naging pagpo-post ni private prosecutor Atty. Amando Virgil Ligutan habang umuusad ang Senate impeachment trial nitong Miyerkules, Agosto 12, 2026.
Sa Facebook post ni Ligutan, na nakita umano ni Sison bandang 11:29 ng umaga nitong Miyerkules, mababasang idiniin sa publiko ng naunang abogado na pangunahing prinsipyo raw ng lahat ng abogado na hindi payagan ang misleading questions sa cross-examination.
“A principle [all] lawyers and law students know by heart: Misleading questions are [not] allowed even on cross-examination,” ani Ligutan.
Kaugnay ito sa naging pagtatalo nina private prosecutor Atty. Lorna Kapunan at Atty. Kristine Ferrer, mula sa defense panel, tungkol sa kung maaaring “yes” or “no” lang daw ang isagot ng testigo sa cross-examination, at usapin sa misleading questions.

Sa naging manipestasyon ni Sison bago matapos impeachment trial nitong Miyerkules, idiniin niyang nakakabahala raw na makita ang ganoon ang kinikilos ng isang private prosecutor.
Aniya, nasasaad daw sa Rule 18 ng Rules of Impeachment hindi maaaring magkomento sa publiko ang mga kagaya nilang abogado kaugnay sa merito ng kasong pinag-uusapan.
“I find it troubling that a private prosecutor would do this in the middle of a courtroom hearing. Because as far as I am concerned, the impeachment court is also a court of decorum. And the Rules of Impeachment, under Rule 18, actually prohibits participants, especially lawyers, from commenting about the merits of the case,” pagsisimula niya.
Ani Sison, hindi raw sila “naive” o walang muwang sa nais puntuhin ni Ligutan at mahalaga raw na respetuhin nila ang mga kapuwa nila miyembro sa Bar.
“I just really find it in bad taste to do this at this time. And I think it's appropriate to do that to a fellow member of the Bar. Because even as we sit on the opposing side of this hall, we remain to be both members of the Bar, and as officers of the Court, we owe each other respect, politeness, or even kindness,” ‘ika niya.
“It doesn’t take one to be a lawyer to know the first thing our parents teach us to do is humility,” pagtatapos pa niya.
Samantala, hindi naman na pinagbigyan ng presiding officer na si Senator-Judge Chiz Escudero na magpaliwanag si Ligutan, bagkus nilinaw niyang matagal na raw nilang napapansing may isang panig sa defense o prosecution na laging nagkokomento sa publiko.
Dahil dito, tatalakayin umano nila sa darating na Lunes, Agosto 17, 2026, ang pagbubuo ng bagong ruling sa impeachment trial kaugnay sa naturang isyu.
