Direktang kinuwestiyon ni Senator-Judge Alan Peter Cayetano ang abogado ng Prosecution panel na si Atty. Reynaldo Robles kaugnay sa mga pamantayan umano sa “fraud” kung mapapatunayang hindi ang Special Disbursing Officer (SDO) ang naglabas ng confidential funds.
Sa interjection ni Cayetano sa ika-20 araw ng Senate impeachment nitong Martes, Setyembre 1, 2026, pinuntirya niya ang pagtatanong kay Robles kaugnay sa usapin ng “fraud” at nilinaw naman ng huli na malinaw daw na nakasaad sa Joint Circular na dapat ang SDO ang kumubra ng confidential funds.
“I just want to clarify your theory. Is your theory that basta’t hindi ‘yong SDO ang mag-release no’ng funds, meron na siyang fraud? Is it just a violation or meron na siyang fraud?” ani Cayetano.
Tugon naman ni Robles, “I think we have to refer to the Joint Circular in that regard. It is very clear in the Joint Circular that the SDO who is supposed to disburse the funds. And in fact, in the Joint Circular, the SDO is not even supposed to transfer possession of the funds to another accountable officer.”
Dagdag pa niya, “I would submit that the answer is yes. If the SDO transfers the funds to another person who is not an accountable officer, a SDO, and not branded, that would be illegal.”

Sunod naman ni Cayetano, hindi ba raw tungkulin ng isang accountable officer na ibigay operatiba ang confidential funds upang maimplementa umano ito sa field.
“When someone is the accountable officer, like in this case of confidential funds or intelligence funds, let’s say the good Colonel was the SDO pero hindi siya ‘yong operative sa field, hindi ba ire-release din niya sa isang operative, na ang operative na ‘yon ang puwede namang magbigay doon sa tao sa field?” aniya.
Diin pa ni Cayetano, “In this case, what’s the difference of a SDO giving it to Colonel Lachica, then Lachica following the operation?”
Depensa naman ni Robles, “Hindi po kasi ganoon, e. ‘Yon pong confidential funds, ina-advance ng SDO sa pondo ng DepEd. Kapag pinasa niya sa iba, ina-advance niya sa susunod na tao. Tapos ia-advance pa sa susunod na tao, wala na pong proper accountability. Sa tingin ko po at nakalagay sa Joint Circular, bawal po ‘yon.”
Inurirat naman ni Cayetano kung sa SDO raw maihahatol ang pananagutan sakaling magkaroon ng pangyayaring mali o fraud.
Paglilinaw ni Robles, “Tatlo po kasi ‘yong accountable officer na nakalagay doon sa Joint Circular. Makikita n’yo po doon ‘yong SDO, ‘yong accountant, and the Head of the Agency.”
Samantala, pumagitna naman sa palitan nina Cayetano at Robles ang presiding officer na si Senator-Judge Chiz Escudero at nilinaw niyang naglabas daw ng Notice of Disallowance sa tatlong kuwarter ng confidential funds ng Office of the Vice President (OVP) ang Commission on Audit (COA).
Nagsanhi umano ito nang malaman ng COA ang pagbibigay ni ex-OVP SDO Gina Acosta ng kinubra nitong confidential funds ng OVP kay dating Vice Presidential Security and Protection Group (VPSG) head Col. Raymund Lachica.
“With the indulgence of Senator-Judge Cayetano, we might be threading on the counsel testifying already on facts that are not yet testified to by any witness they have called,” ani Escudero.
Diin pa niya, “The COA stated that they issued a Notice of Disallowance on the three quarters on the OVP confidential fund when they learned that it was given by Gina Acosta to Col. Lachica. That was the basis of their issuance of the Notice of Disqualification.”
Samantala, hindi naman na nakipag-argumento si Cayetano matapos ni Escudero at nilinaw nitong kung mapapatunayan daw na nagkasala si VP Sara, hindi na ito makakatakbo sa pagka-Pangulo at mapapaalis ang huli sa opisina nito.
Paliwanag ni Cayetano, mahalaga raw para sa kanilang mga senator-judges na malaman kung isang irregularidad o isang awtomatikong fraud ang mga anomalya sa pagkubra ng confidential funds ng SDO at sakaling may naganap na mali.
