Makukulong ng hanggang 40 taon ang dalawang dating opisyal ngNational Agribusiness Corporation (Nabcor) at isang pribadong indibidwal kaugnay ng pagkakasangkot nila sa₱10 bilyong pork barrel fund scam noong 2008.

Kabilang sa pinatawan ng Sandiganbayan ng mula 24 taon hanggang 40 taong pagkakakulong sina dating Nabcor Human Resources manager Encarnita-Cristina Munsod, dating General Services Unit head Romulo Relevo, at private individual Margie Tajon-Luz, pangulo ng GabayMasa Development Foundation Inc.

Sa desisyon ng anti-graft court, napatunayang nagkasala ang tatlo sa kasong malversation of public funds (2 counts) at 2 counts ng graft (Republic Act 3019) dahil sa paglustay ng Priority Development Assistance fund (PDAF) ng namayapang si Eastern Samar Rep. Teodulo Coquilla.

Paliwanag ng korte, kahit na sinunod lamang nina Munsod at Relevo ang utos ni Nabcor president Alan Javellana, mayroong pa ring pananagutan ang mga ito dahil sa inilakad nilang dokumento na nagresulta sa pagpapalabas ng pondo sa GabayMasa para sa bogus na proyekto.

“The prosecution was able to prove that …accused Relevo, Munsod, and Luz conspired with accused Coquilla. [They] willingly went along with the ignoble scheme of accused Coquilla by completing the act of embezzling the PDAF-drawn funds through the implementation of a fictitious and non-existent livelihood project,” ayon pa sa anti-graft court.

Binanggit ng hukuman, walang natanggap na mga binhi ang mga benepisyaryo ng livelihood project na pinondohan ni Coquilla, gamit ang kanyang PDAF.

"Records reveal that the reported distribution of the seedlings and instructional materials to the intended beneficiaries is highly questionable, considering that none of the 13 selected beneficiaries confirmed receipt of the items. Moreover, eight of these purported beneficiaries were either unknown at their given addresses or did not claim their confirmation letters. Other intended beneficiaries did not respond to the COA Audit Team," paglalahad ng hukuman.

“Under these given facts, there can be no question that the accused acted in concert to attain a common purpose. The prosecution was able to prove by moral certainty that the accused, in conspiracy with one another, misappropriated the PDAF-drawn public funds. The evidence of the prosecution is overwhelming and has not been overcome by the accused,” dagdag pa ng anti-graft court.
