Inalmahan ng defense team ang apela ng House prosecution team na mabuksan ang lahat ng nakumpiskang gamit ni dating Pangulong Rodrigo Duterte nang maaresto siya noong Marso 11, 2025, at dalhin sa detention facility ng International Criminal Court (ICC). 

Sa inilabas na bagong dokumento ng ICC na nakapetsa noong Biyernes, Hunyo 26, 2026, mababasang inilahad ng lead counsel ni FPRRD na si Mr. Peter Haynes, KC, na umapela raw ang Prosecution sa Trial Chamber noong Mayo 1, 2026, na mag-utos sa Registry upang payagan silang mabuksan ang mga gamit ng dating Pangulo. 

Batay umano sa obserbasyon ng Defense team at Registry, pinayagan ng Trial Chamber ang apela ng Prosecution na ma-freeze ang perang nakumpiska nang maaresto noon si FPRRD. 

Ngunit itinuring daw ng Trial Chamber na “premature” na mag-isyu sila ng ruling para mabuksan ang mga materyal na gamit ni FPRRD kaya nagbigay raw ito ng direktiba sa Prosecution na magsumite ng bagong apela para mabuksan ang iba pang gamit ng dating Pangulo. 

Noong Hunyo 9, 2026, muling umapela ang Prosecution sa Trial Chamber na mabuksan ang ilang pang mga gamit ni FPRRD na nasa kustodiya pa ng Registry.

Diin ni Haynes, resonable naman daw ang pag-apela ng Prosecution sa Trial Chamber na mabuksan ang mga gamit ni FPRRD para sa kanilang imbestigasyon. 

“A request by the Prosecution to access materials held by the Registry must be relevant and sufficiently reasoned. Reasonable grounds must exist to believe that the proposed search is likely to yield evidence necessary to the investigation and that the measure sought is both necessary and proportionate to the pursuit of a legitimate aim,” aniya. 

Ani Haynes, dahil daw sa dahilang ito, hindi pipigilan ng Defense team ang apela ng Prosecution sa Trial Chamber na mabuksan nila ang gamit ni FPRRD 

“The Defence asks that, should the Prosecution’s [REDACTED] produce information that is personal to Mr Duterte or his family and which is not relevant to the investigation, the Prosecution take appropriate measures to limit access thereof to the minimum number of persons.Such information should also be destroyed or permanently deleted at the earliest possible opportunity,” paalala naman niya. 

Sa kabila nito, tinututulan naman umano ng Defense teama ang apela ng Prosecution na magkaroon ng susi sa lahat ng mga gamit ni FPRRD na nasa kustodiya ng Registry at pinatutsada niyang isa lang daw itong fishing expidition. 

“For the reasons set out above, the Defence does not oppose the Prosecution’s request to access the [REDACTED] in the custody of the Registry. The Defence does oppose, and requests that Trial Chamber III reject, the Prosecution’s request in relation to ‘all keys’ in the Registry’s custody,” paglilinaw niya. 

Samantala, habang sinusulat ito, nanatili pa rin si FPRRD sa detention center ng ICC sa The Hague, Netherlands, kaugnay sa kinakaharap niyang kasong crimes against humanity sa naganap na madugong war on drugs sa bansa noon. 

Nakatakdang opisyal na magsisimula ang trial laban sa kaniya sa darating na ika-30 araw ng Nobyembre.
