Tinanggap ng Office of the Solicitor General (OSG) ang naging desisyon ng Korte Suprema sa hindi pag-apruba sa petisyong temporary restraining order (TRO) ng kampo ni Sen. Ronald “Bato” dela Rosa kaugnay sa inisyung arrest warrant ng International Criminal Court (ICC).
Matatandaang inanunsyo ng Korte Suprema sa isinagawa nilang press briefing noong Miyerkules, Mayo 20, 2026, ang nalikom nilang boto na 9-5-1 sa hindi pagtanggap sa TRO ni Dela Rosa.
Ayon sa inilabas na pahayag ng OSG sa kanilang Facebook page nitong Huwebes, Mayo 21, idiniin nilang nabigo raw si Dela Rosa na patunayang mayroon siyang malinaw na karapatan para bigyan ng agarang proteksyon at bigo rin daw na magpakita na nilalabag ang kaniyang karapatan.
“It stressed that Senator Dela Rosa failed to demonstrate a clear and unmistakable right that required immediate protection, that he failed to show an actual or imminent violation of such right,” anila.

Dagdag pa nila, “[A]nd the CIDG subpoena he invoked had already been recalled, and that he failed to establish an urgent and irreparable injury that would justify the Court's intervention.”
Anang OSG, pinapatunayan daw ng hindi pag-apruba ng Korte Suprema sa TRO ni Dela Rosa na walang legal na makakahadlang sa pagsisilbi ng arrest warrant laban sa senador.
“The Court's denial of the TRO affirms that there is no legal impediment to the enforcement of the ICC warrant,” ‘ika nila.
Diin ng OSG, hindi raw dapat mabigyan ng kaukulang proteksyon mula sa hukuman ng bansa ang isang indibidwal na nagtatago sa mga awtoridad at batas.
“In its Comment, the OSG further discussed the interplay of the guarantee of due process, the demand for accountability, balancing of competing interests, and proper availment of judicial and equitable remedies, i.e. that one who deliberately places himself beyond the reach of law enforcement by going into hiding should not be entitled to ask for equity,” saad nila.
Panghihimok ng OSG, dapat daw na tingnan ng Korte Suprema ang pinakamahalagang layunin ng pagpapatupad ng batas na pagkamit sa tunay na hustisya at mananatili raw silang nakatuon sa pagsusulong nito sa kaso ng pagharap ni Dela Rosa sa crimes against humanity.
“The OSG awaits the release of the Court's full ruling addressing the other preliminary issues,” pagtatapos ng OSG.
