Makailang beses pinaalalahanan ni House Justice Committee chairperson at Batangas 2nd District Rep. Gerville Luistro si SAGIP Partylist Rep. Paolo Marcoleta sa deliberasyon ng impeachment cases nila laban kay Vice President Sara Duterte.
Ayon sa ikalawang pagdinig na isinagawa ng House Committee on Justice nitong Martes, Marso 3, 2026, nanindigan si Marcoleta na mababaw umanong ground ang Notices of Disallowance (NDs) at Audit Observation Memoranda (AOMs) dahil appealable at contestable naman daw ang mga ito.
“The notices of disallowance do not presuppose guilt on the part of the vice president. It is not an amount to a prosecution. Kaya huwag po nating gamitin itong mga dokumento na ito, as if meron nang ginawang kamalian ang ating bise presidente…” ‘ika niya.
Nagawa ring ipasok ni Marcoleta na hindi umano kasama sa trabaho ng Kongreso ang pagbubukas ng House Quad Committee (Quad Comm) ng mga envelope noong nakaraang taon.
“Isa pa po, ‘yon pong mga ginawa ng Quad Comm noong nakaraang taon. ‘Yon pong pagbubukas ng mga envelope. I don’t think, ‘yan po ay kasama sa trabaho ng Kongreso,” aniya.

Dagdag niya, “Dahil ang pag-audit ay trabaho ng COA. Meron po tayong Latin legal maxim: ‘potestas delegata non delegari,’ ‘delegated power should not be delegated further.’”
Sa kalagitnaan nito, pinaalalahanan ni Luistro si Marcoleta na magtuon umano sa pagdinig sa impeachment complaint na kanilang ginagawa.
“The Hon. Marcoleta is reminded to confine the manifestation to the subject matter of the impeachment proceeding,” singit niya, “This is not about Quad Comm, this is impeachment proceeding on the two complaints against the Vice President. Please stick to the subject matter of this impeachment proceeding.”
Depensa pa naman ni Marcoleta, “But the envelope—’yong opening of the envelopes, hindi po ba may kinalaman ‘yon dito?”
Diin ni Luistro, dapat daw ihayag ni Marcoleta sa pagdinig sa Quad Comm ang kaniyang pahayag at hindi sa pagdinig ng deliberasyon ng impeachment complaint ng Justice Committee.
“If you have concerns about the proceedings of Quad Comm, perhaps you should address it in another forum but not in the impeachment proceedings. The Hon. Marcoleta is so reminded to stick in the subject matter,” anang Justice Committee chairperson.
“‘Yon lang naman po… notice of the disallowance. Ito po ay mga dokumento lamang na ito ay appealable, contestable, at hindi ito nangangahulugang na ang bise presidente ay may ginawang irregular dahil ito ay contestable,” giit at pagtatapos naman ni Marcoleta.
