Sinabi ni Bataan 1st District Rep. Geraldine Roman na maaaring i-regulate ang social media platforms upang maiwasan ang pagpakakalat ng fake news at misinformation subalit hindi puwedeng i-regulate ang content dahil ito ay "unconstitutional."

Nagsagawa ang House Tri-Comm hearing hinggil sa cybercrimes at fake news nitong Martes, Abril 8, kung saan muling inimbitahan ang "vloggers" at iba pang personalidad sa media gaya na lamang ng dating Pangalawang Pangulo at ABS-CBN News anchor na si Kabayan Noli De Castro.

"I’ve realized that we can regulate social media platforms but not content, because that is unconstitutional," pahayag ni Roman.

Naniniwala umano si Roman na ang content creation ay fundamental right sa free speech, na ginagarantiya naman ng Konstitusyon.

"We cannot regulate opinions. We cannot regulate how and what content creators should produce, but, we can regulate social media platforms by empowering them and requiring them to act as gatekeepers," paliwanag pa niya. 

Posible raw na kapag niregulate ang content ay puwedeng magsampa ng reklamo ang content creator at umabot pa sa Supreme Court, at "by default" daw, ito ay puwedeng manalo dahil isa nga ito sa mga karapatan ng malayang pamamahayag. 

Samantala, inusisa naman ni Roman si De Castro tungkol sa ilang mga mamamahayag na hindi tumatalima sa code of ethics ng Kapisanan ng mga Brodkaster ng Pilipinas (KBP).

"Unang-una ho, hindi na kinakailangang dumaan sa KBP kapag may gano'n, 'yong mismong station ang nagdi-discipline sa kaniya tungkol d'yan," anang mamamahayag.

Bago pa man ang hearing na ito, matatandaang sa isang press conference na ginanap noong Marso 2025, sinabi ni Roman na nagmumungkahi siyang magkaroon ng tinatawag na "Digital Council of the Philippines."

Ang magiging tungkulin umano ng non-government regulatory body na ito ay mag-set ng ethical standards sa paggawa ng digital content.

"I came up with a legislative measure, which is the creation of a Digital Council of the Philippines because I am against censorship. I am against government control. This council will be composed of content creators, and it will have a registry," pahayag pa niya.

Naniniwala umano si Roman na ang karapatan sa kalayaan sa pamamahayag o freedom of expression ay "constitutional" at sagrado kaya hindi dapat pigilan.

"The right to freedom of expression is sacred. It is constitutional. So, when we legislate, we always try to find the least restrictive means, so it does not stand in conflict [with that provision]. We believe that if we have a code of standards, code of ethics, the council, which is not run by the government, will have the authority to eradicate fake news," aniya.
