Nagbago ang ihip ng hangin, at sinasabi ngayon ni Senate President Vicente Sotto III na posibleng mangyari ang “no-el” o no-election scenario sa 2019 para iprayoridad ang pagtatalakay sa paglilipat ng gobyerno sa federal system.

Binawi kahapon ni Sotto ang kanyang pagkontra sa ideya ni House Speaker Pantaleon Alvarez na ipagpaliban ang midterm elections sa Mayo, 2019 para bigyang-daan ang pagrerepaso sa panukalang draft federal constitution at ayusin ang transition sa federalismo.

Sa briefing kasama ang mga mamamahayag kasunod ng turnover ng Consultative Committee (Con-Com) ng draft federal charter sa Senate, sinabi ni Sotto na hindi na kailangang amyendahan ang 1987 Constitution para maipagpaliban ang national elections.

“I would like to apologize, that indeed what I mentioned earlier, Article 6, Section 8 of the Constitution says that the regular election for senators and members of the House of Represenatatives shall be held on the second Monday of May, but I forgot there was a liner for that: ‘unless otherwise provided for by law,’” ani Sotto.

“Therefore, we do not need a plebiscite to postpone the elections. A law, by both houses of Congress, may be able to postpone (the elections). So I stand corrrected,” dugtong niya.

Nang tanungin kung aaprubahan ng Senado ang hakbang na magpapaliban sa halalan, sumagot si Sotto na, “possible, if it is indeed necessary.”

“Kung gusto talaga naming magawa kaagad, siguro ‘yon ang kailangan,” sinabi pa niya.

Gayunman, nilinaw ni Sotto na kailangang magkasundo rito ang mga miyembro ng Mataas na Kapulungan.

WALA SA BATAS

Samantala kahit na hindi pa niya natatanggap ang kopya ng draft charter, ibinasura ni Sen. Francis Escudero ang pagpapaliban sa midterm polls at nanindigan na nangangailangan ito ng pagbabago sa 1987 Constitution.

Sa hiwalay na press briefing kahapon, sinabi ni Escudero, isang abogado, na hindi ito maisusulong ng mga nagpapanukala ng “no-el” kung wala ito sa batas.

“I believe that you cannot legislate that because it is clear in the Constitution that the term of a congressman is three years and there should have an election every three years,” aniya, binanggit ang Article 6 ng kasalukuyang konstitusyon.

“Senators have a six-year term, and there should have an election every three years for the 12 members of Senate,” diin niya.

Tutol din si Sen. Grace Poe sa panukalang kanselahin ang halalan sa Mayo, 2019 at kumpiyasa na hindi aayunan ng Senado at ng publiko ang naturang hakbang.

COMELEC HANDA NA

Sa kabila ng mga usap-usapan na posibleng hindi matuloy ang halalan sa Mayo 2019, sinabi ng Commission on Elections na patuloy silang nakatutok sa paghahanda para sa midterm polls.

“The institution remains focused on the task at hand: preparing for the 2019 National and Local Elections, scheduled for May 2019,” ani Comelec Spokesman James Jimenez sa isang pahayag.

Tutol din ang National Movement for Free Elections (NAMFREL) sa ideya na ipagpaliban ang halalan.

“We should adhere to periodic and genuine elections,” giit ni NAMFREL Secretary General Eric Alvia.
