Iniutos ng Office of the Ombudsman na kasuhan si Negros Oriental governor Roel Degamo kaugnay sa illegal disbursement ng P480 milyong calamity fund na ginamit sa infrastructure projects ng probinsya noong 2012.

Sinampahan si Degamo ng 11 counts ng paglabag ng Anti-Graft and Corrupt Practices Act.

Bukod kay Degamo, pinapasampahan din ng kahalintulad na kaso sina Provincial Treasurer Danilo Mendez, Provincial Accountant Teodorico Reyes at Provincial Engineer Franco Alpuerto.

Pinakakasuhan din sina Mendez at Reyes ng 11 counts ng falsification of public documents.

Ayon kay Ombudsman Conchita Carpio-Morales, ang nasabing calamity fund ay para lang sa pagkukumpini, rehabilitasyon, at pagpapatayo ng mga istrukturang sinalanta ng kalamidad.

Inatasan din ni Morales na kasuhan ng graft sina Alejandro Lim, Jr. ng Lim General Contractor Corporation, Mark Anthony Clemente ng CTC Builders and Supplies, Inc. Danny Chan ng AJAN Jeada, Inc., Wilfredo Chu ng Bigfoot Construction and Supply, Farouk Macarambon ng Fiat Construction Services, Maribel Ranola ng Legazpi Premium Development Corporation atd Ricardo Abriol Santos ng Richmark Construction and Supply.

Base sa imbestigasyon ng Office of the Ombudsman, noong Disyembre 2011 ay humiling si Degamo ng pondo para sa pagkumpuni ng mga infrastructure na napinsala ng Typhoon Sendong at ng lindol noong February 2012.

Noong Hunyo 5, 2012, nag-isyu ang Department of Budget and Management (DBM) ng Special Allotment and Release Order (SARO)na nagkakahalaga ng P961.5 milyon, kung saan P480.7 milyon ang agad ibinigay sa provincial government, ayon sa Ombudsman.

Noong Hunyo 19, 2012, ipinaalam ng DBM kay Degamo na binawi na nito ang SARO dahil hindi sinunod ng lalawigan ang mga alituntunin ng infrastructure projects.

“Despite the notice, Degamo, et. al. proceeded to award the 11 infrastructure contracts amounting to P143.2 million, representing the 15 percent advance payment to contractors,” paliwanag ni Morales.

Naglabas din ng 11 na Notices of Disallowance ang Commission on Audit (COA) nang matuklasang “certified available” pa ang pondo sa kabila ng pagkansela sa nabanggit na SARO.

“If respondents had reservations on the legality of the withdrawal of the positive SARO, they could have asked a higher executive authority or secured a judicial directive allowing them to retain control of the funds released to the province. This, respondents failed to do,” ani Morales. (Rommel Tabbad)
