De Lima, umalma sa desisyon ng Korte Suprema ugnay sa impeachment vs VP Sara

Inalmahan ni Mamamayang Liberal (ML) Partylist Rep. Leila de Lima ang naging desisyon “with finality” ng Korte Suprema kaugnay sa apela ng Kamara na i-reverse ang desisyon nila noon tungkol sa impeachment complaint laban kay Vice President Sara Duterte.

Ayon sa inupload na video statement ni De Lima sa kaniyang Facebook page nitong Biyernes, Enero 30, sinabi niyang hindi raw tinukoy ng Korte Suprema ang mga “merits” sa mga alegasyon laban kay Duterte at nagbase lang ito sa “procedural grounds” kaya puwede raw ulit magsampa ng parehong reklamo sa nasabing opisyal. 

“In upholding its original decision, the Supreme Court also affirmed that its ruling does not absolve VP Sara Duterte of the offenses she is accused of committing,” pagsisimula niya.

Dagdag pa niya, “The Court’s decision was based on procedural grounds and did not rule on the merits of the allegations against the VP. Kaya nga pwedeng-pwedeng magsampa uli ng impeachment case laban kay VP Sara even with the same substantive grounds contained in last year’s complaint.” 

Ani De Lima, lumabas daw na “derogation” ng konstitusyonal na kapangyarihan at “prerogatives” ng Korte Suprema ang pagbabasura nito sa nasabing apela ng Kamara. 

“However, while it basically rests on technicalities, the Resolution denying the Motion for Reconsideration appears to be a derogation of the House’s constitutional powers and prerogatives,” aniya. 

Paliwanag niya, “Ang nagkapareho do’n sa main decision or original decision at sa resolution ngayon, at nakakabahala pa rin: Tulad sa naunang desisyon, may paglihis ang Korte Suprema sa letra at diwang nasa Saligang Batas ukol sa pantay at magkahiwalay na kapangyarihan ng Hudikatura at Lehislatura.” 

Anang mambabatas, ginamit raw na pagkakataon ng Korte ang mga nakalatag sa mosyon ng Kamara upang “ma-restructure,” “refurbish,” at “refine” ang “novel doctrinal pronouncement” sa pamamagitan ng pagdaragdag sa orihinal na “ponencia.” 

“As the latest SC ruling closes several doctrinal loopholes in its original decision, the Court also took the opportunity presented by the Motion for Reconsideration to restructure, refurbish, and refine novel doctrinal pronouncements via an addendum to the original ponencia,” saad niya. 

“As such, this second decision is not merely a denial of the MR or an affirmation of the original decision. It reads like an altogether new decision but with the same result,” paglilinaw pa niya. 

Pagpapatuloy niya, bumuo rin raw nga mga bagong rule, timeline, at consequences ang Korte na hindi naman makikita sa teksto. 

“By redefining what constitutes the ‘initiation’ of impeachment and by converting legislative inaction into a constitutionally operative act, the Court has crossed from interpretation into legislation,” ‘ika niya. 

Pagdidiin niya, “It is judicial legislation—well-intentioned perhaps, but constitutionally infirm—because it straightjackets a co-equal branch through judicial overreach. The Supreme Court has not merely reviewed the House’s compliance with clear constitutional commands—it has rewritten the operating manual for impeachment initiation. It has supplied new rules, new timelines, and new consequences that are nowhere found in the text.” 

Ayon pa kay De Lima, lubhang mapanganib raw ang epekto ng desisyon ng Korte para mapahina ang “separations of power” dahil sa kanilang pagbabago bilang “political safeguard” na impeachment case sa judicially managed process na taliwas sa Konstitusyon. 

“The effect is to discipline the procedure that the Constitution left for Congress to decide. This sets a very dangerous precedent that weakens separation of powers by transforming impeachment from a political safeguard into a judicially managed process, contrary to the design and spirit of the Constitution,” pagtatapos pa niya. 

Samantala, habang sinusulat ito, wala pang inilalabas na pahayag, tugon, o reaksyon ang Korte Suprema kaugnay rito.
