Pinangunahan ni Sen. Rodante Marcoleta ang paghahain ng mosyon na i-dismiss na ang impeachment ni Vice President Sara Duterte.
Sa sesyon ng Senado nitong Miyerkules, Agosto 6, 2025, ibinala ni Marcoleta ang desisyon ng Supreme Court (SC) na ideklarang unconstitutional ang articles of impeachment ng Pangalawang Pangulo.
“Mr. President, when the Supreme Court (SC) negates the actions of a co-equal branch of government, it does not assert its superiority. Instead, it upholds the supremacy and the dominance of the fundamental law of the land—-the Constitution,” ani Marcoleta.
Binigyang-diin din ng nasabing bagong senador ang parte ng pahayag ng SC na wala na raw jurisdiction ang Senado sa naturang impeachment laban kay VP Sara.
“And so the Supreme Court has already spoken, the last arbiter of law. It says the complaint is unconstitutional, is void ab initio, is violative of due process. The Senate never acquired jurisdiction over this. It is immediately executory. And on that note, Mr. President, I respectfully move that the impeachment complaint be dismissed,” saad ni Marcoleta.
Matatandaang ayon sa nasabing desisyon ng Korte Suprema, nilabag umano ng ikaapat na impeachment complaint ang one year rule at due process sa proseso ng isang impeachment.
“The SC has ruled that the House impeachment complaint versus VP Sara Duterte is barred by the one-year rule and that due process or fairness applies in all stages of the impeachment process,” saad ng nasabing desisyon.
