Tuluyang ibinasura ng Pasay Metropolitan Trial Court ang reklamong “acts of lasciviousness’ laban sa independent contractors na sina Jojo Nonez at Richard Cruz na isinampa ng GMA Sparkle artist na si Sandro Muhlach. 

Ayon sa ulat ng State of the Nation, programa ng GMA Network, ibinasura ng Pasay MTC ang naturang reklamo dahil nakapaloob na raw ito sa rape case na isinampa ng Department of Justice (DOJ) aban kina Nonez at Cruz. 

Tinawag ng Pasay MTC na “overkill” umano ang naturang reklamo dahil isa na raw ito sa mga kinokonsidera nilang "element of rape" sa pamamagitan ng sexual assault. 

"Indeed, the acts of lasciviousness being complained of before this court are necessarily included in the charge of rape before the RTC," anang Pasay court.

Dagdag pa nito, "Again, the prosecution resorted to an overkill by filing the instant Information for Acts of Lasciviousness when clearly the acts are constitutive and/or simultaneous and are deemed absorbed in the rape case with the alleged sole intent and purpose of arousing and ultimately gratifying the accused’ own sexual desires."

Matatandaang pumutok ang isyu sa pagitan ni Muhlach at nina Nonez at Cruz noong Agosto dahil umano sa panghahalay sa kaniya ng nasabing dalawang independent contractors.
