IPOPHL's, nag-react sa mathematical discovery ng guro sa Quezon-Balita

Nagbigay ng reaksiyon ang Intellectual Property Office of the Philippines sa nag-viral na post ng public school teacher sa probinsya ng Quezon na si Danny V. Calcaben tungkol sa umano’y mathematical discovery nito.

Sa Facebook post ng IPOPHL’s noong Lunes, Hulyo 22, ipinaliwanag nila na hindi umano bahagi ng IP Code of 1997 na protektahan ang isang mathematical formula mula sa banta ng pagkopya rito.

“As part of our mandate to keep the public informed about creations of the mind or intellectual property (IP), the IP Office of the Philippines would like to note that the IP Code of 1997 does not protect a mathematical formula, hence, does not give its creator the right to prevent others from copying it,” pahayag ng IPOPHL’s.

“According to Section 175 of Republic Act 8293, the protection of copyright shall not extend to any idea, procedure, system method or operation, concept, principle, discovery or mere data as such, even if they are expressed, explained, illustrated or embodied in a work; news of the day and other miscellaneous facts having the character of mere items of press information; or any official text of a legislative, administrative or legal nature, as well as any official translation thereof,” wika nila.

Dagdag pa nila: “Meanwhile, Section 22 of the law has explicitly excluded discoveries, scientific theories and mathematical methods, among others, from patent protection.”

Isa raw kasing “fact” ang mathematical formula. At ang “fact” bilang bahagi ng public domain ay hindi maaaring protektahan ng Intellectual Property maliban na lang kung inihayag ito sa malikhain at natatanging paraan.

Samantala, hindi rin umano mabibigyan ng “patent” ang isang mathematical formula maliban na lang kung nagagamit sa “real-world applications” ang metodo at proseso nito.

Gayunman, maaari umanong maprotektahan ng copyright ang manuskrito nito na magsisilbing “tangible expression” at manipestasyon ng kahusayan ng isang tao.

Matatandaang kalakip ng post ni Calcaben ang liham niya sa pangulo upang humingi ng tulong para protektahan ang umano'y discovery niya mula sa banta ng plagiarism.
