Hiniling ng isang abogado sa Office of the Ombudsman (OMB) na ilabas ang mga kopya ng statements of assets, liabilities and net worth (SALNs) ni dating Pangulong Rodrigo Duterte at kaniyang anak na si Vice President Sara Duterte para sa taong 2007 hanggang 2023.

Sa isang liham na ipinadala kay Ombudsman Samuel R. Martires noong Hunyo 5, hiniling ni Atty. Dino S. de Leon na ilabas ang SALNS ng mga Duterte matapos ipuntong ang SALNs ng public officials ay "matters of public concern.”

Sinabi ni De Leon sa kaniyang liham na kung tatanggi ang OMB na ilabas ang SALNs ng mga Duterte, mapipilitan siyang humingi ng “judicial at constitutional reliefs” na magagamit niya bilang isang mamamayan.

Ikinalungkot ni De Leon ang tinawag niyang "scandalous corruption of public funds" na naganap umano noong administrasyon ni dating Pangulong Duterte.

"As a citizen of the Republic, I am alarmed by these atrocious allegations on the mishandling of funds for the pandemic, especially considering that the plunder appears to have happened at a time when our country was facing a national crisis," ani De Leon.

"Even more, it appears that the plunder of the Filipino people's money was ordered by [former] President Duterte himself when he authorized the unjustified transfer of P47.6 billion of funds from the Department of Health to the Procurement Service of the Department of Budget and Management," dagdag niya.

Sinabi ni De Leon na gumawa na siya ng mga pagtatangka noong nakaraan upang ma-secure ang SALNs ng mga Duterte. Gayunman, aniya, tinanggihan ng Ombudsman ang kaniyang kahilingan dahil hindi siya nakakuha ng notarized letter mula mismo sa declarant.

Ngunit, sinabi ni De Leon na ang notarized letter mula sa declarant ay isang "unreasonable requirement" na pinawalang-saysay ang kaniyang karapatan bilang isang mamamayan na suriin ang mga SALN ng mga pampublikong opisyal.

Sa kaniyang liham, binanggit ni De Leon ang Section 5 Executive Order No. 02, series of 2016, kung saan binigyang-diin ang obligasyon ng mga pampublikong opisyal na maghain at gawing available para sa pagsisiyasat ng kanilang mga SALN.

Nagbabala siya na anumang positibong aksyon na nakakadismaya sa constitutional rights ng mga mamamayan na ma-access ang mga SALN ng mga pampublikong opisyal ay maaaring ituring na isang pagtataksil sa tiwala ng publiko.

Kamakailan lamang, inilalabas sa publiko at media ang mga SALN ng mga opisyal ng gobyerno basta't sumusulat sila ng request letter sa Ombudsman.

Gayunpaman, noong Setyembre 1, 2020, nilagdaan ni Ombudsman Martires ang isang memorandum circular na pinamagatang "Amended Guidelines on Public Access to SALN of Business Interests and Financial Connections Filed Within the Office of the Ombudsman."

Nakasaad sa 2020 circular ang: "No SALN will be furnished to the requester unless he/she presents a notarized letter of authority from the declarant allowing the release of the requested SALN."

"If the person requesting is not the declarant or the declarant's duly authorized representative, but has [a] notarized letter of authority from the declarant allowing [the] release of the requested SALN, he/she shall be required to present two original valid IDs, one of which is a government issued ID bearing the requester's picture and signature," dagdag pa ng circular.

Nauna nang ipinaliwanag ni Martires na naglabas siya ng amended guidelines alinsunod sa mga probisyon ng Implementing Rules and Regulations of Republic Act No. 6713, ang Code of Conduct and Ethical Standards for Public Officials and Employees.
