Ibinasura na ng Sandiganbayanang forfeiture case laban kay dating Armed Forces of the Philippines (AFP) nang matapos ang plea bargaining agreement sa pagitan niya at ng Office of the Ombudsman.
Sa ruling ng 4th Division ng anti-graft court, binanggit na nabawi na ng gobyerno ang lahat ng ari-ariang hinahabol nito kay Garcia alinsunod na rin sa kanilang plea bargaining agreement.
“Wherefore, in view of the foregoing, the motion to withdraw the petition filed by the Republic of the Philippines, as represented by the Office of the Special Prosecutor, is hereby granted, and Civil Cases No.s 0193 and 0196 are hereby dismissed without prejudice,” sabi ng korte sa desisyon na ipinonente ni Associate Justice Bayani Jacinto.
Sa petisyon ng prosekusyonkaugnay sa naturang civil case laban kay Garcia, ipinaliwanag na wala na silang sapat na ebidensyang susuporta sa pagbawi sa iba pang ari-arian ng dating heneral ng militar.

“Hence, it is withdrawing these cases to prevent further waste of the court’s time, effort, and resources, knowing for a fact that at present, substantially all of the properties may be forfeited had already been forfeited by the state,” banggit pa ng korte.
Noong Setyembre 13, 2022, ibinigay na ng Ombudsman sa Bureau of Treasury (BTr) ang₱53.6 milyong halaga ng tseke at 11 na titulo ng lupa ni Garcia dahil na rin sa plea bargaining agreement nito sa pamahalaan.
Nakapiit pa rin ngayon sa National Bilibid Prison si Garcia matapos hatulan ng korte sa mas magaan na kasong direct bribery at money laundering noong 2022.
Nag-ugat ang kaso sa umano ay ill-gotten wealth ni Garcia, asawang si Clarita, at mga anak na sina Ian Carl, Juan Paulo at Timothy Mark.
