Pinabulaanan ng National Union of Journalists of the Philippines (NUJP) nitong Sabado, Dis. 4, ang mga reklamong cyber libel na inihain ni Department of Energy Secretary Alfonsi Cusi at ng negosyanteng si Dennis Uy laban sa 18 opisyal at reporter ng pitong news outlets na naglathala ng mga istorya ukol sa kasong graft na isinampa laban sa dalawang opisyal.
Nitong Biyernes, Dis. 3, nagsampa ng kaso si Cusi laban sa 18 opisyal at reporter ng Manila Bulletin, ABS CBN Nees, BusinessWorld, Rappler, Philippine Star, GMA News at Business Mirror.
Humihingi ang Energy Secretary ng hindi bababa sa P200 milyon mula sa mga news organizations para sa mga “danyos” na natamo niya dahil sa mga isinapublikong mga artikulo.
Sa isang pahayag, sinabi ng NUJP na ang mga reklamo ay “naglalayong takutin at paamuhin ang midya” at ang P200 milyon na pinasala mula sa bawat isa sa pitong media outfits “ay maaaring pumilay sa mga news organizations kung ipatutupad.”

Sinabi ng Unyon na ang mga istoryang inilathala ng mga mamamayahag ay batay sa using press confrenece, isang press release at isang reklamong inihain sa Office of the Ombudsman.
“For Secretary Cusi to say in his complaint that the journalists ‘accused [him] of graft]’ is a total misunderstanding, if not a deliberate way to mislead the public, of the role of journalists. The journalists did not accuse him; the complainants did. The journalists only covered the complaint,” sabi ng NUJP.
“Journalists are not businessmen, politicians, brokers, or lobbyists out to find a way to ‘settle misunderstandings and differences.’ We are the public guardians — out to report on matters like this, a difference of opinion between the executive and the legislative, the latter pointing out that there were shortcuts to approve the sale of billion-peso shares of the Malampaya project, a crucial public infrastructure,’ dagdag nito.
Hinimok ng NUJP si Cusi na bawiin nito ang mga reklamo at sa halip ay “ituon ang kanyang atensyon sa pagpapaliwanag sa publiko kung ano ang nangyari sa Malampaya gas deal.”
Ipinunto din ng grupo ang panawagan nito na i-decreminalize ang libel at igalang ang demokratikong espasyo sa pagbabantay sa mga opisyal ng gobyerno.
“May we remind Secretary Cusi of what the Supreme Court said about public officials suing for libel: Without a vigilant press, the government’s mistakes would go unnoticed, their abuses unexposed, and their wrongdoings uncorrected,” dagdag ng NUJP.
