Pinanindigan ni Manila Mayor Francisco “Isko Moreno” Domagosa ang kanyang direktiba na magpataw ng “no face shield” sa lungsod ng Maynila at hinimok ang national government na “pumunta sa korte” kung nais nito ang declaratory relief at pigilan ang pagpapatupad ng nasabing polisiya.
“If they are not happy, they can go to court and ask for declaratory relief. But our decision will stay,”sabi ni Domagosa sa isang panayam sa ANC nitong Martes, Nob. 9.
“Maliwanag naman yung kapakanan ng tao. Sa aming local governments, yung hinaing lang naman ng tao ang aming dinidinig. That’s the purpose of governance – tao una,” dagdag niya.
Nauna nang sinabi ni Presidential Spokesperson Harry Roque na maituturing na “null and void” ang polisiya laban sa pagsususot ng face shield dahil paglabag ito sa “existing executive policy decreed by the President himself, in the exercise of police powers.”

Nilagdaan ni Domagosa nitong Lunes, Nob. 8, ang isang executive order na nag-aalis sa face shield policy sa lungsod.
Sa ilalim ng Executive Order No. 42, ang pagsusuot ng face shield ay hindi na kailangan sa lungsod ng Maynila maliban na lang sa mga ospital at iba pang medical facilities.
Sinabi ni Domagoso na habang iginagalang niya ang opinyon ni Roque na isang abogado, walang kontrol ang Pangulo sa mga local executive sa ilalim ng Local Government Code.
“Control and supervision are two different matters. Control is the power to reverse, supervise is the power to oversee if laws are correct and not contradictory to existing laws,” sabi ni Domagoso.
“And I think the President, who is a lawyer and a former City Mayor, will agree with me. He has no control over the mayors. He has the power of supervision,”dagdag ng akalde.
Pinabulaanan din niya ang mga akusasyon na hindi niya sinusunod ang chain of command sa executive branch dahil ang lungsod ng Maynila ang unang lungsod na hindi nag-require ng paggamit ng face shield.
“When we speak of chain of command, we speak of military and we are not uniformed personnel. We are civilian authority mandated by the people within our territorial jurisdiction,” sabi ni Domagoso.
Dagdag niya, ilang buwan na niyang patuloy na hinihiling sa Department of Health (DOH) na pag-aralan ang mga “epekto at benepisyo” ng mga face shield. Gayunpaman, wala pa ring resultang ibinigay sa kanya ang DOH.
“They have not done their assignment. It’s been one year and eight months. Have we not learned how to deal with COVID-19? We are the only country in the world using face shields,”ani Domagoso.
“What they want us to do is something that is not science-based,”dagdag niya.
Para sa kanya, dagdag pabigat sa mga tao ang pagbili ng face shield at nagdudulot ito ng discomfort sa mga matatanda at hinihika.
“What is there with faced shields? Why insist on something, making it mandatory without science? It’s unfair to the people,” sabi ni Domagoso.
Sa halip ay dapat na pagtuunan ng pansin ang pagbabakuna sa mga tao, isulong ang face mask, pagbili ng mga science-based na gamot na makatutulong sa mga pasyenteng may kritikal at malubhang COVID-19, dagdag ng alkalde.
