Tapos na ang imbestigasyon ng itinalagang inter-agency committee on extra-judicial killings (EJKs) kaugnay ng pagkamatay ng siyam na aktibista sa naganap na joint police-military operations sa mga probinsya ng Southern Tagalog noong Marso 7.
Pagbubunyag ni Justice Secretary Menardo Guevarra, chairman of the committee, nitong Lunes, Nobyembre 1, “the AO 35 committee (Inter-Agency Committee on Extra-Legal Killings, Enforced Disappearances, Torture and Other Grave Violations of the Right of Life, Liberty, and Security of Persons) is ready with its first report and we’re just going over it.”
Ang operasyon ay inilunsad upang tugisin ang mga hinihinalang communist rebel sa mga probinsya ng Cavite, Laguna, Rizal at Batangas.
Gayunpaman, siyam ang naitalang napaslang kasama ang ilang pang nasugatan at naaresto. Kalauna’y tinawag na “Bloddy Sunday” ang insidente ng ilang human rights group.

Dahil dito, inudyukan ng Korte Suprema ang pag-aapura sa mga patakaran sa mandato na paggamit ng mga body-worn camera o alternatibong video at audio recording device ng mga law enforcers sa pag-aresto o pagsisilbi ng search warrant.
Sa ilalim ng mga patakaran, ang mga ebidensyang nakuha ng mga law enforcer na hindi nagsuot ng kanilang camera o alternative device ay ituturing na “inadmissible for the prosecution of the offense for which the search warrant was applied.”
Dagdag nito, ang mga nasasakupan ng search o arrest warrant ay dapat ipaalam na ang pagpapatupad ng mga warrant ay naitala mula sa simula ng operasyon hanggang matapos.
Kung magresulta ng pagkamatay sa pagsisilbi ng search warrant, “an incident report detailing the implementation of the search, the reasons why such death occurred, the result of related inquest proceedings, if any— including possibly those against the officer or officers causing the death together with other relevant documents — shall likewise be submitted” sa korteng nag-isyu ng warrant.
Maaari lang mag-isyu ng mga warrant of arrest o search warrant ang mga trial court sa loob ng kanilang territorial jurisdiction. Binawi ng mga panuntunan ang awtoridad sa mga executive judge ng ilang trial court, tulad ng sa Maynila at Quezon City, na mag-isyu ng mga warrant na maaaring saanman sa bansa.
Ang inter-agency committee sa EJKs o AO35 ay binubuo ng Department of Justice, Department of the Interior and Local Government, Department of National Defense (DND), Office of the Presidential Adviser on the Peace Process, Presidential Adviser on Political Affairs, Armed Forces of the Philippines, Philippine National Police at National Bureau of Investigation (NBI).
