Sinabihan ni Human rights lawyer Jose Manuel "Chel" Diokno nitong Biyernes, Setyembre 10 si Ombudsman Samuel Martires dahil hinahadlangan umano nito ang isinusulong na transparency sa gobyerno at pinipigilan ang karapatan ng mamamayan na magbigay ng opinyon tungkol sa public concern.

Sa Facebook post ni Diokno, sinabi niya na karapatan ng mamamayan ang magkomento, lalo na tungkol sa Statements of Assets, Liabilities, and Networth (SALNs) ng mga government officials at empleyado.

Nag-react si Diokno sa panukala ni Martires na kakasuhan ang mga taong nagkokomento tungkol sa SALNs at ipakukulong ng hindi bababa ng limang taon kapag napatunayang nagkasala.

“I disagree with Ombudsman Martires. Trabaho ng Ombudsman i-promote ang transparency, hindi ang hadlangan pa ito. The Constitution also guarantees our right to comment on matters of public concern—at kasama doon ang SALNs,” ani Diokno, chairman ng Free Legal Assistance Group (FLAG)

“Nakakalimutan yata nila na ang required sa batas, hindi lang pag-file kundi pagsiguro ng public access sa SALNs," dagdag pa niya.

Idinagdag pa niya ang isang Supreme Court ruling, “While custodians of SALNs like Ombudsman Martires can regulate how SALNs can be inspected or copied, ‘such discretion does not carry with it the authority to prohibit access, inspection, examination, or copying’ [A.M. No. 09-8-6-SC, June 13, 2012].”

“Imbes na tanggihan ni Martires ang hinihiling na SALN ni Pangulong Duterte, dapat ibinigay ito. Ang batas ang boss ng Ombudsman, hindi ang Pangulo," pagdidiin niya.

Ayon sa Memorandum No.1 na inilabas ni Martires noong Setyembre 1, 2021: "A copy of a public official’s SALN may be released if “he/she is the declarant or the duly authorized representative of the declarant; the request is upon lawful order of the court in relation to a pending case; and the request is made by this Office’s Field Investigation Office/Bureau/Unit (FIO/FIB/FIU) for the purpose of conducting fact-finding investigation.”

Sinasabi rin sa memorandum na, “in all other instances, no SALN will be furnished to the requester unless he/she presents a notarized letter of authority from the declarant allowing the release of the requested SALN.”
