Tinanggihan ng Sandigan­bayan ang mosyon ni Davao del Norte Rep. Antonio "Tonyboy" Floirendo, Jr. na maibasura ang kinakaharap na kasong graft, kaugnay ng pagkakasangkot nito sa isang joint venture agree­ment para sa isang proyekto ng Bureau of Corrections (BuCor) noong 2003.

Sa inilabas na ruling ng 6th Di­vision ng anti-graft court, tinukoy nito na natiyak ng prosekusyon sa isinampa nitong kaso na isang opisyal ng bayan si Floirendo at mayroon din itong direct o indirect interest sa nasabing negosyo.

Binanggit na malaking bahagi ng shares of stocks ng Tagum Ag­ricultureal Development Com­pamny (TADECO) ay pag-aari ni Floirendo, na nagsisilbing kon­gresista ng Davao del Norte mula 2001-2004.

Aabot sa 75,000 shares ng TA­DECO o 89 na porsiyento ng oust­standing capital stock nito ang pag-aari ng kongresista nang pirmahan ang kasunduan noong 2003.

"At this point, there is no need to look into matters beyond the four corners of the Information. This Court finds that the facts charged in the Information suffi­ciently allege the essential elements of the second mode of violation of Section 3(h) of R.A. 3019. The other arguments of the accused are matters of defense which are better threshed out during the trial on the merits," paglilinaw pa ng korte.
