Maaaring ang Supreme Court (SC) nga ang huling nagpapasya sa mga usapin tungkol sa batas, subalit hindi sa “impeachment matters”.

Ito ang iginiit kahapon ni Senate President Aquilino Pimentel III, kasunod ng pagbibigay-diin na tanging ang Senado ang maaaring magpasya kung patatalsikin sa puwesto si Chief Justice Maria Lourdes Sereno—na sa botong 8-6 ay tinanggal sa puwesto ng mga kasamahan niyang mahistrado makaraang paboran ang quo warranto na inihain ng Office of the Solicitor General upang madiskuwalipika siya sa puwesto.

“The Supreme Court is supreme in a lot of things but not in everything. In impeachment matters the Supreme Court is not supreme, because the Senate is the one and only impeachment court,” saad sa pahayag ni Pimentel kahapon. “The Chief Justice is an ‘impeachable official’ who can be removed only after impeachment by the House and conviction by the Senate.”Batay sa Konstitusyon, ang Kamara ang mayroong “exclusive power to initiate all cases of impeachment”, habang ang Senado ay may “sole power to try and decide all cases of impeachment”.

“The reputation and esteem of this present Supreme Court will now rise or fall on the basis of the soundness or unsoundness of this controversial decision upholding a very unusual remedy to oust a sitting Chief Justice,” sabi pa ni Pimentel, at hinimok ang SC na pag-aralan ang naging desisyon nito, at bigyan ng pagkakataon si Sereno na umapela.

Kontra rin sa naging pasya ng SC sina Senators Antonio Trillanes IV, Joel Villanueva, Sonny Angara, Bam Aquino, at Franklin Drilon.

Sang-ayon naman si Sen. Tito Sotto, habang sinegundahan ni Sen. Panfilo Lacson ang posibilidad na hindi na magsusumiteng articles of impeachment ang Kamara.

“Ang biggest ‘winners’ sa SC decision ay ang mga abogadong pulpol na handa sanang magkalat ng katangahan sa impeachment trial na hindi na mangyayari, dahil malamang hindi na ipadala ng House ang Articles of Impeachment sa Senado,” tweet ni Lacson.
