Bilang na ang mga araw ng mga employer na sangkot sa illegal contractualization makaraang lagdaan kahapon ni Pangulong Rodrigo Duterte ang executive order (EO) na nagbibigay-tuldok sa “endo” o end-of-contract scheme, na nagkakait ng seguridad sa mga manggagawa.
Layunin ng executive order, na pinirmahan ni Duterte sa selebrasyon ng Labor Day sa Cebu City, na protektahan ang karapatan ng mga manggagawa sa seguridad sa pinaglilingkuran at maiiwas ang mga ito sa mga mapang-abusong contractual employment.
Gayunman, nauunawaan ng Pangulo na hindi sapat ang nasabing EO at muling hinimok ang Kongreso na amyendahan ang Labor Code upang ganap na maresolba ang problema sa labor contracting sa bansa—at sinertipikahan na niyang “urgent” ang katulad na panukala.
Magpinsang paslit nagkayayaang maligo sa lawa, nalunod
“I remain firm in my commitment to put an end to endo and illegal contractualization,” sinabi ng Pangulo sa kanyang pagdalo sa selebrasyon ng Araw ng Paggawa sa IEC Convention Centre sa Cebu City.
“I assure you that this government will never cease in its efforts to provide every Filipino worker with full, dignified and meaningful employment. They deserve no less than decent and comfortable lives,” ani Duterte. “However, I believe that in order to implement an effective and lasting solution to the problems brought about by contractualization, Congress needs to enact a law amending the Labor Code.”
‘YOUR DAYS ARE NUMBERED’
Binasa ang Section 2 ng pinirmahan niyang EO, sinabi ni Duterte na ipinagbabawal ang contracting at subcontracting, at pinagtitibay ang karapatan ng mga manggagawa sa security of tenure.
“To all non-compliant and abusive employers, and their so-called cabo, who are engaged in labor-only contracting, your days are numbered,” sabi pa ng Pangulo. “I have warned you before and I warn you again...stop endo and illegal contractualization.”
LABOR GROUPS, UMAYAW
Gayunman, ilang grupo ng manggagawa ang hindi kuntento sa EO, at sinabing ipagpapatuloy nila ang laban para sa mga karapatan ng mga obrero sa bansa.
Naniniwala si Rene Magtubo, chairman ng Partido Manggagawa, na ang EO na pinirmahan ng Presidente ay para sa mga employer, at hindi para sa mga manggagawa.
“The EO that was signed definitely is an EO for the employers not for the workers,” saad sa pahayag ni Magtubo. “We felt, we are taken for a ride. There was no consultation with our 5th draft submitted to the Office of the President last April 13.”
Sinegundahan naman ni Julius Cainglet, ng Federation of Free Workers, ang reaksiyon ni Magtubo.
“We are not happy with the EO,” ani Cainglet. “We wanted an order that is reflective of his sympathy for contractual and agency workers. What we got is the same as the previous issuances of government that has set aside direct hiring as the norm.”
LABOR CODE AAMYENDAHAN
Samantala, pinuri naman ni Senator Joel Villanueva, chairman ng Senate Committee on Labor, Employment and Human Resources Development, ang EO ni Duterte at iginiit na patuloy niyang isusulong sa Senado ang batas na “[will] end labor abuses and promote worker’s right to security of tenure.”
Suportado rin ni Senate President Aquilino Pimentel III ang panawagan ni Duterte na amyendahan ang Labor Code para sa “lasting solutions” laban sa contractualization.
Sinabi rin ni Senator Bam Aquino na handa ang oposisyon sa paggawa ng batas na tatapos sa endo.
Ngayong 17th Congress, naghain si Aquino ng ilang panukala na nakatuon sa kapakanan ng manggagawang Pilipino, kabilang ang mga overseas Filipino worker, freelancers at reservists.
