Ibinasura ng Court of Tax Appeals (CTA) ang kasong tax evasion laban kay Jeane Napoles, anak ng umano’y pork barrel fund scam mastermind na si Janet Lim-Napoles.

Sa ruling ng 3rd Division ng CTA, ipinasyang i-dismiss ang P17 milyong tax case dahil sa kawalan ng sapat na ebidensiya.

Si Jeane ay inaakusahan ng Bureau of Internal Revenue (BIR) na hindi nagbayad ng buwis sa umano’y pag-aaring P54.73 milyong Ritz Carlton condominium unit sa Los Angeles, California at co-ownership na P1.49 milyon farm lots sa Pangasinan mula 2011-2012.

Paliwanag nito, isa lamang siyang estudyante at walang taxable income at tinanggap niya lamang ang naturang ari-arian bilang regalo.

“The prosecution failed to prove that there is any income tax due from accused, creating reasonable doubt as to the guilt of accused. Accordingly, the Court finds that the evidence presented is not sufficient to sustain a conviction of accused since the prosecution failed to discharge the burden to prove all the essential elements of the crimes attributed to the accused,” sabi pa ng hukuman. - Rommel Tabbad at Beth Camia
