Ito ang nilinaw ng chairman ng House Committee on Justice kahapon sa bantang maglalabas ng warrant of arrest laban kay Chief Justice Maria Lourdes Sereno sakaling hindi ito sumunod sa subpoena ng panel.

Pinanindigan ni Oriental Mindoro Rep. Reynaldo Umali na kahit na mayroon silang constitutional mandate na umaksiyon, ang lahat, kabilang ang punong mahistrado, ay dapat na sumunod dito.
“Hypothetical naman ‘yun e kaya nga nag-executive session kami ngayon para pag-usapan namin ‘yon kasi I was just speaking my mind because I firmly believe the extraordinary power given to the committee on justice as an impeachment committee is a constitutional mandate that ought to be followed by everyone,” aniya, matapos magbabala ang ilang senador na magkakaroon ng constitutional crisis sa gitna ng patuloy na pagtanggi ni Sereno na dumalo sa impeachment deliberations.
‘EXTREME CAUTION’
Nagbabala sina Senate Minority Leader Franklin Drilon at Senador Francis Escudero ng “constitutional crisis” kapag ipinilit ng House panel na arestuhin si CJ Sereno.
“It is not available in an impeachment proceeding. In effect, a subpoena will compel Sereno in an impeachment complaint to testify against herself. I therefore urge Cong. Umali to exercise extreme caution in using the coercive powers of Congress to issue a subpoena against Sereno as there is no basis and will provoke a needless constitutional crisis,” ani Drilon.
Sinabi ni Drilon na walang kapangyarihan ang House panel na maghain ng subpoena at lalong wala itong karapatan na magpalabas ng mandamento de aresto.
“It may result to constitutional crisis,” diin ni Escudero.
TETESTIGO
Samantala, nagpahayag sina SC Associate Justices Teresita Leonardo De Castro at Noel Tijam at iba pang opisyal ng korte na humarap sa impeachment hearing kapag binigyan sila ng “clearance” ng High Court en banc.
Tetestigo rin si Justice Secretary Vitaliano Aguirre II kaugnay sa aniya’y pagmanipula at pag-antala ni Sereno sa resolusyon sa kahilingan ng DOJ na gawin sa labas ng Mindanao ang pagdinig sa kasong rebelyon ng Maute Group.
Inoobliga rin ng House Justice Committee ang Office of the Ombudsman na mag-produce ng Statements of Assets, Liabilities And Net Worth (SALN) ni Sereno.
Iniutos ni Umali ang paglabas ng subpoena duces tecum sa Ombudsman kahapon matapos matanggap ng panel ang isang SALN lamang na inihain ni Sereno sa University of the Philippines (UP), bago siya mapabilang sa High Tribunal.
Kasama rin sa ipina-subpoena ng House panel ang dalawang psychiatrist na tetestigo sa mga akusasyon na binigyan nila si Sereno ng failing mark sa mandatory psychological evaluation na requisite sa pagtatalaga sa kanya sa SC.
