Sa imbestigasyon ng National Bureau of Investigation (NBI), lumalabas na pinatay ng mga pulis ng Caloocan City ang Grade 11 student na si Kian Loyd delos Santos sa kasagsagan ng anti-illegal drugs operation noong Agosto 16.

Dahil dito, nagsampa ng reklamo sa Department of Justice (DoJ) ang NBI laban sa mga pulis na sangkot sa operasyon sa ilalim ng Article 248 ng Revised Penal Code; paglabag sa Article 128 ng RPC; at planting of evidence sa ilalim ng Section 29 ng Republic Act 9165 o Comprehensive Dangerous Drugs Act of 2002.

At ilan sa mga kinasuhan ay sina Chief Inspector Amor Cerillo, PO1 Jeremias Tolete Pereda, PO1 Jerwin Roque Cruz, at PO3 Arnel Oares na bumaril at pumatay kay Delos Santos.

Sa resulta ng imbestigasyon, sinabi ng NBI na “Victim fired shots at them (police) upon sensing their arrival so they have no other option to fire back at Victim, hitting him in the head causing his instantaneous death.”

“In the case at bar, PO3 Arnel Oares and his cohorts accosted Victim and afterwards dragged him towards Tullahan River and shot him without mercy,” base sa findings ng NBI na isinumite sa DoJ nitong Huwebes, ilang araw matapos maghain ng reklamo sa DoJ ang magulang ni Delos Santos laban sa apat na pulis noong Agosto 25.

Ayon sa NBI, negatibo ang resulta ng paraffin examination na isinagawa sa mga kamay ni Delos Santos. Bukod sa baril, nakuha rin mula kay Delos Santos ang dalawang pakete ng umano’y shabu.

Sa forensic examination na isinagawa ng NBI at sa autopsy na isinagawa ng Philippine National Police (PNP) at ng Public Attorney’s Office (PAO) sa katawan ng biktima ay nagpapatunay na “an undisputable conclusion that Kian was shot while in somewhat kneeling/fetal position.”

“These further negate the claim of PO3 Oares and his cohorts that Kian engaged them in a shootout,” ayon sa NBI.

“If Kian indeed engaged them in a shootout, he would have sustained gunshot wounds on the frontal parts of his body,” dagdag nito.

MGA SAKSI ILIPAT SA PAO

Hiniling ng PAO sa Senado na ilipat sa kanilang kustodiya ang mga saksi sa pagpatay kay Delos Santos.

“In the interest of justice, may we respectfully request from your good office that the custody of the witnesses to the killing of Kian Loyd Delos Santos who are under the Senate’s protective custody be transferred to the Public Attorney’s Office (PAO),” mababasa sa liham ng PAO na ini-address kay Senate President Aquilino “Koko” Pimentel III.
