Kinasuhan si Guagua, Pampanga Mayor Dante Datu Torres ng technical malversation sa Sandiganbayan Second Division sa paggamit umano ng P2.76 milyon pondo ng gobyerno para sa rehabilitasyon ng Manuel P. Santiago Park, kahit pa may ibang pinaglaanan ng nasabing halaga.
Ayon sa isinulat ni Graft Investigation and Prosecution Officer III Sergio Duke B. Villar sa charge sheet laban sa alkalde, nahaharap ang huli sa kaso ng ilegal na paggamit ng pondo ng bayan, alinsunod sa Article 220 ng Revised Penal Code.
Hulyo 1, 2014 nang napaulat na maglabas si Torres ng P2,760,000 para bayaran ang mga gastusin sa pagpapaganda ng nabanggit na parke, bagamat nakasaad sa ordinansa ng munisipalidad na ang partikular na pondo ay inilaan sa rehabilitasyon ng Aurelio Tolentino Frontage Area, sa pagbili ng refrigerator van, at ilang heavy equipment.
Itinakda sa P6,000 ang piyansa ni Torres.

Nakasaad sa Article 220 ng Revised Penal Code na “any public officer who shall apply any public fund or property under his administration to any public use other than for which such fund or property were appropriated by law or ordinance shall suffer the penalty of prision correctional in its minimum period or a fine ranging from one-half to the total of the sum misapplied.”
Kasabay nito, “any damages or embarrassment shall have resulted to the public service. In either case, the offender shall also suffer the penalty of temporary special disqualification.” - Czarina Nicole O. Ong
