Pag-absuwelto kay Marcelino, iaapela ng PNP-Balita

Nagpahayag ang Philippine National Police-Drug Enforcement Group (PNP-DEG) nitong Biyernes na ang desisyon ng Department of Justice (DoJ) na ibasura ang drug charges laban kay Lt. Col. Ferdinand Marcelino at sa Chinese interpreter na si Yan Yi Shou ay maglalatag ng panganib na alinsunuran sa drug operations na isinasagawa ng law enforcement agencies.

Sa inilabas na pahayag ni PNP-DEG spokesman Supt. Enrico Rigor, nakasaad na nagulat siya sa resolusyon kamakailan ng DoJ na bumabaligtad sa resolusyon noong Setyembre 15, 2016 ni Assistant State Prosecutor Alexander Q. Suarez, na inaprubahan ni Senior Deputy State Prosecutor Richard Anthony D. Fadullon, at nagsasabing mayroong sapat na katibayan na sina Marcelino at Yan ay tumutupad nang naaayon sa batas nang sila ay matagpuan ng mga operatiba ng pulisya at ng Philippine Drug Enforcement Agency (PDEA) sa raid sa isang umano’y drug den sa Sta. Cruz, Manila, noong Enero 21, 2016.

Umaabot sa 77 kilo ng hinihinalang shabu ang nakumpiska sa operasyon.

“According to the DoJ ruling on the Marcelino case, prior coordination with PDEA is dispensable as long as an arrested person will able to obtain a certification from the AFP, NBI or any other Law Enforcement Agency (LEG) that he/she is sharing vital information on illegal drugs even if the said clarification does not necessarily states that said sharing pertains to the operations he/she was arrested for,” sabi ni Rigor.

“The said resolution likewise wants us to believe that a sheer allegation of an arrested intelligence officer, that after he/she managed to get hold of the drugs, he/she will eventually tell the Law Enforcement Agencies he/she is sharing information to about the drugs he confiscated, even if the Law Enforcement Agency has no prior knowledge of the fact that he will confiscate the said drugs,” dagdag niya.

Ayon sa DEG, ang naturang senaryo ay hindi katanggap-tanggap sa anumang Law Enforcement Operation.

“The PNP-DEG as well as PDEA will exert all legal efforts seeking reversal of the said resolution,” aniya.
