Bagamat mariing inihayag ni Pangulong Rodrigo Duterte na naninindigan at panig siya sa pulisya, itutuloy pa rin ng Department of Justice (DoJ) ang prosekusyon sa mga pulis na sangkot sa pagpatay kay Albuera, Leyte Mayor Rolando Espinosa, Sr.
“It (pahayag ng Pangulo) will not affect. We will continue with our preliminary investigation,” sinabi kahapon ni Justice Secretary Vitaliano Aguirre II.
Ito ang pagtitiyak ng kalihim kasunod ng pahayag ng Pangulo na hindi niya papayagang makulong ang mga pulis na isinasangkot sa tinukoy ng National Bureau of Investigation (NBI) na “rubout”, at binigyang-diin pang kontrolado niya ang DoJ.
Sa kabila nito, iginiit ni Aguirre, gayundin ni Atty. Salvador Panelo, chief legal counsel ng presidente, na walang ginawang impeachable offense ang Presidente, gaya ng iginigiit ng kritiko nitong si Senator Antonio Trillanes IV.

Matatandaang matapos ang masusing imbestigasyon ay inirekomenda ng NBI ang pagsasampa ng kaso sa 24 na pulis dahil sa umano’y planadong pagpatay kay Espinosa habang nakapiit sa sub-provincial jail sa Baybay City, Leyte nitong Nobyembre 5.
Bumuo na rin ang DoJ ng panel of prosecutors na magsasagawa ng preliminary investigation, na kinabibilangan nina Senior Assistant State Prosecutor Lilian Doris Alejo, tatayong chairperson ng panel; Senior Assistant State Prosecutor Olivia Torrevillas, Assistant State Prosecutors Jinky Dedumo at Karla Cabel at Prosecution Attorney Moises Acayan.
Inirekomenda ng NBI ang paghahain ng multiple murder laban sa mga opisyal ng Criminal Investigation and Detection Group (CIDG)-Region 8 na sina Supt. Marvin Marcos, Supt. Noel Matira, Chief Insp. Leo Laraga, Senior Inspectors Deogracia Diaz at Fritz Blanco, Senior Police Officers Melvin Cayobit, Eric Constantino, Benjamin Dacallos, Juanito Duarte at Alphinor Serrano Jr., police officers Johnny Ibañez, Norman Abellanosa, Niel Centino, Bernard Orpilla, Lloyd Ortiguesa, Jerlan Cabiyaan, Cristal Gisma, at Divine Grace Songalia.
Mahaharap din sa kaparehong kaso sina Chief Insp. Calixto Canillas Jr., Insp. Lucresito Candelosas, at police officers Antonio Docil, Mark Cadilo, John RuelDaculan, at Jaime Bacsal ng PNP Regional Maritime Unit 8.
Bukod pa ang kasong perjury kina Laraga, Abellanosa, at Paul Olenadan.

Kasabay nito, nilinaw kahapon ng Malacañang na hindi pipigilan ng Pangulo ang anumang legal na proseso laban sa 24 na pulis.
“The recent pronouncements of the President pertaining to the PNP, standing by his men, are critical to maintaining their high morale, with the end in view of succeeding in the anti-drug campaign,” sabi ni Presidential Communications Secretary Martin Andanar. “It should not be misinterpreted to mean that the President will intervene in investigations or any legal proceedings in order to exculpate erring cops.”
