Inatasan ng Supreme Court si Senator Leila de Lima at ang Office of the Solicitor General na magsumite ng memorandum kung immune o hindi pwedeng kasuhan si Pangulong Rodrigo Duterte sa loob ng anim na taon nito sa panunungkulan.
“Without necessarily giving due course to the petition, the petitioner (De Lima) and the OSG are directed to submit their respective memorandum on the issue of whether the President of the Republic of the Philippines, as the sole respondent in this case, is immune from suit including this one, within a non-extendible period of 10 days from notice,” ayon sa SC.
“It is noted that the issue of immunity of the President from suit is a prejudicial question to be first resolved before the Court decides whether to require him to comment or not pursuant to the Rule on the Writ of Habeas Data,” nakasaad pa sa resolusyong binigkas ni lawyer Theodore O. Te, hepe ng SC Public Information Office.
Nitong Lunes, nagsampa ng Writ of Habeas Data si De Lima, kung saan hinihiling nito sa SC na pigilan si Duterte sa personal na pag-atake sa Senadora, gayundin ang pangangalap at publikasyon ng ‘private affairs’ at aktibidad ng una.
