Malayang umaresto at gumalugad ang pulis at militar kahit walang search at arrest warrants, sa ilalim ng state of national emergency na idineklara ni Pangulong Rodrigo Duterte, ngunit ito ay may kaakibat na kondisyon.
Nakapaloob ito sa Memorandum Order hinggil sa guidelines, na nilagdaan ni Executive Secretary Salvador Medialdea.
“No warrantless arrests shall be effected unless the situation falls under any of the following circumstances, among others: when the person to be arrested has committed, is actually committing or is attempting to commit an offense in the presence of an arresting officer,” nakasaad sa memorandum order.
Aarestuhin din ang sinuman kapag gumawa ito ng kasalanan, o alam ng awtoridad na ito ay may ginawang pagkakasala.

Agad ding aarestuhin ang mga preso na umeskapo; at kung ang aarestuhin ay boluntaryong inalis ang kanyang karapatan laban sa warrantless arrest.
Bukod sa warrantless arrests at searches, nakasaad din sa guidelines ang deployment ng pulis at militar sa mga pangunahing lansangan, pampublikong lugar tulad ng mga mall at transport terminal; pagpapaigting sa intelligence gathering at mabilis na imbestigasyon at paglilitis sa mga sangkot sa paghahasik ng kaguluhan.
Ang guidelines na ipinalabas ng Palasyo noong Martes ng gabi ay sisiguro umano na hindi masisikil ang civil liberties ng taumbayan, habang isinasagawa naman ng mga awtoridad ang pagsupil sa paghahasik ng kaguluhan.
“To ensure respect for and protection of the fundamental civil and political rights of our citizens, there is also a need to define and delimit the measures that the AFP and PNP can undertake during the state of lawless violence,” ayon pa sa order. (Genalyn Kabiling)
