Hindi na kailangang magtungo sa Senado si Sen. Jinggoy Estrada upang pangasiwaan ang pag-eempake ng kagamitan sa kanyang tanggapan.
Ito ang iginiit ng prosekusyon sa Sandiganbayan Fifth Division matapos humiling ang senador na payagan siyang magtungo sa Senado sa Hunyo 6-8 upang mag-alsabalutan dahil magtatapos na ang kanyang termino sa Hunyo 30.
Sa kanilang isinumiteng oposisyon sa Fifth Division, pinaalalahanan ng prosekusyon ang korte na ilang beses nang sinopla ng korte ang mga mosyon ni Estrada na humihiling na magampanan nito ang kanyang opisyal na tungkulin sa Senado.
“It is with more reason that this Honorable Court should deny the instant request which is made merely for purposes of winding up his affairs at the Senate which includes the turning over of office equipment to the Senate Custodian, and overseeing the segregation of his office and personal properties,” giit ng prosekusyon.

“These matters do not even involve the performance of his official duties as a Senator as they can be carried our without the presence of Accused Estrada within the premises of the Senate,” dagdag nila.
