Na kay Camarines Rep. Leni Robredo ang lahat ng karapatan para tawaging presumptive Vice-President elect, ayon sa abogado ng kongresista na si Atty. Romulo Macalintal.

Sinabi ni Macalintal na bagamat hindi pa opisyal na sumasailalim sa canvassing ng Kongreso bilang National Board of Canvassers ang mga boto para sa presidente at bise presidente, walang dudang si Robredo na ang “presumptive vice-president elect”, gaya ng tinatawag na ngayong “presumptive president” si Davao City Mayor Rodrigo Duterte, batay sa resulta ng hindi opisyal na pagbilang sa mga boto sa website ng Commission on Elections (Comelec).

“The nationwide certificates of canvass (COCs) from all provinces and highly urbanized cities showed that vice-presidential candidate Representative Leni Robredo garnered 14,322,666 votes while Ferdinand ‘Bongbong’ Marcos was credited with 13,963,767 votes or a difference of 358,899,” saad sa pahayag ni Macalintal.

At bagamat ang mga boto mula sa overseas at local absentee voting, gayundin ng mga bilanggo, ay nagbigay kay Marcos ng 96,290 lamang, sinabi ni Macalintal na ang 358,899 lamang ni Robredo sa kabuuan ng mga boto ay nagbigay sa kongresista ng kumportableng margin of victory na 262,609 na boto.

“Clearly, the victory of Ms. Robredo in the vice-presidential race is unassailable,” ani Macalintal.

Tungkol naman sa mga akusasyon ng pandaraya sa transmission ng mga boto, hiniling ng abogado sa kampo ni Marcos na magprisinta ng sarili nilang kopya ng ERs o COCs na maaaring makuha sa boards of election inspectors o boards of canvassers.

“To prove errors or irregularities in the electronic transmission of these results, one has to prove that his own authentic copies of the ERs and/or COCs do no match with those recorded in the Comelec and/or Congress,” paliwanag ni Macalintal.

Kaugnay nito, kumpiyansa naman ang kampo ni Marcos na pagbibigyan ng Comelec ang hiling nila na magsagawa ng system audit sa transparency at central servers ng Automated Election System (AES) bago magsimula ang opisyal na canvassing ng Kongreso sa mga boto sa Miyerkules.

Sinabi ni Jose Amor Amorado, pinuno ng Quick Count Center ni Marcos, na tiwala silang pahihintulutan sila ng Comelec na magsagawa ng system audit at magkaroon ng access sa mga transmission log, vote counting machine, USB devices, BGAN or Broadband Global Area Network, digitally signed election returns (ERs) at decryption keys para mabuksan ang mga nai-transmit na files.
